Abstract
International conventions or rules which are applicable to contract of carriage by sea provide the principle and amount of the sea carrier’s limitation. It has been introduced in order to protect sea carriers and to promote marine transport business, considering marine transport circumstances involving great risks compared to transport by land. By the way, there has been an issue with the amount of limitation of carrier’s liability in Korea as well as foreign countries because the Hague Rules, one of International Conventions, provide not only a clause that the currency in the convention shall be gold value but also ‘100 pounds sterling’ per package or unit as the limitation amount. In Korea, lower courts had ruled that the amount of carrier’s liability should be limited to 100 British pounds sterling per package or unit until the Korean supreme court rendered the judgement that is the object of this paper. However, the Korean supreme court definitely rules that the amount of carrier’s liability, in accordance with the Hague Rules, should be limited to 100 gold value pounds, not British pound, considering the situation in which the Hague Rules were made, circumstances of its amendments, comparison with Hague-Visby Rules, precedents established in prominent foreign cases, etc. It has already been accepted in most countries as established interpretation, starting with the judgement of ‘The Rosa S’ by British court in 1988, even before the judgement of that is the object of this paper was rendered in Korea that the amount of carrier’s liability under the above Rules should be limited to 100 gold value pounds, not British pound and the judgement of ‘The Tasman Discoverer’ by Privy Council in 2004 is thought to put an end to this argument. The judgement that is the object of this paper is considered to be a very reasonable and highly applaudable one which confirms to international precedents, in that reality of international carriage of goods by sea was fully reflected that it was based on presumptive interpretation of carriage contract parties‘ intention and that a solution to the problem which may be caused by gold clause was also prepared.
