시민사회의 이중성과 해방의 조건 - 헤겔 시민사회론과 새로운 규범성 모색

본 논문의 목적은 시민사회의 성격을 분석하고 이를 통해 시민사회에서 해방의 조건을 탐구하는 것이다. 시민사회 개념은 역사적 변화과정을 거치면서 다양한 의미로 사용되고 있으며 시민사회에 대한 규정 역시 다양하게 이루어지고 있다. 이런 변화 속에서 시민사회에 대한 이론적 모형을 정립하기 보다는 시민사회의 성격을 분석함으로써 시민사회에 대한 이해를 추구하며 이에 기반해 시민사회를 구성하는 시민의 규범성을 도출하는 것이 본 논문의 목적이다. 이를 위해 먼저 헤겔의 시민사회에 대한 분석에 기반해 시민사회의 성격을 자발성과 공동성으로 규정하고자 한다. 자의를 포함한 자유로운 의지를 의미하는 자발성은 시민사회가 성립하기 위한 가장 근본적인 성격이다. 왜냐하면 시민사회는 자발적인 관심에 의해 성립되며, 따라서 주관적, 사적 성격을 띠기 때문이다. 그러나 이런 사적관심과 욕구는 충족되기 위해 상호의존적 체계를 필연적으로 요구할 수밖에 없다. 즉 시민들의 욕구충족을 위해 시민사회의 공동성이 필연적으로 요구되며 이것이 공공성으로 발전할 계기가 되는 것이다. 그러나 국가의 공공성을 통한 시민사회의 문제해결은 시장의 과잉과 함께 관료지배체제와 중앙집권화된 권력체제에서 쉽지 않은 실정이다. 따라서 시민사회 자체의 내재적 가치를 살리기 위해 시민의 자율성을 증대하고 협력적 결사체를 형성하기 위한 규범성이 요구된다. 이 지점에서 필자는 자발성이 자의에 머물지 않고 결사체가 집단이기주의가 아니라 연대의 결사체가 되기 위해 한나 아렌트의 ‘행위’개념과 알래스데어 매킨타이어의 ‘실천’개념에 의존하고자 한다. 시민의 ‘행위’와 ‘실천’의 사회적 활동을 통해 시민사회에서 자발적이면서 다원적인 연대적 결사체를 구성하는 길을 해명하고자 하는 것이다.
Abstract
The purpose of this paper is to analyze the characteristics of civil society and to present the conditions for emancipation of civil society. The concept of civil society has been used in various ways through the process of historical change, and various definitions on civil society have also been made. In this change, rather than establishing a theoretical model for civil society, the purpose of this paper seeks to understand civil society by analyzing the characteristics of civil society and to derive the normativity of citizens constituting civil society based on this understanding. To this end, I intend to define the nature of civil society as voluntary and communal based on Hegel's analysis of civil society. Voluntaryness, which means free will, including self-interest, is the most basic nature for civil society to establish. This is because civil society is founded by voluntary interest and therefore by a subjective and private interest. However, such personal interests and desires inevitably require an interdependent system to be met. In other words, the commonality of civil society is inevitably required to satisfy the needs of citizens, and this is an opportunity to develop into publicity. However, solving the problems of civil society through the publicity of the nation is not easy in a bureaucratic and centralized power system, along with the exaggeration of the market. Therefore, a normativity is required to increase citizens' autonomy and form cooperative associations in civil society. At this point, I intend to introduce Hannah Arendt's concept of “action” so that voluntaryness does not remain arbitrary, and restore Alasdair McIntyre's concept of “practice” to become a solidarity, rather than collective egoism. Through the social activities of these citizens' “act” and “practice”, I hope to form a voluntary and pluralistic solidarity associations in civil society.
