Abstract
Hegel's "Philosophy of Rights: Natural Law and State Studies," which marks its 200th anniversary this year, seeks a new form of modern state, criticizing the ancient political thoughts and the modern natural law theorists, formalistic moralists and liberal marketers. The State issue is dealt with in Chapter 3, Ethical Virtue. "Ethical Virtue" is based on abstract unification and universal family, and this family is disbanded into a "civil society." Civil society transitions to a nation of its original meaning, revealing the inner contradictions and dangers of modern capitalist society. Civil society is nothing short of an organization in which atomized individuals are united by personal selfishness. Civil society is on the one hand a "system of wants" to maximize each other's wantss, and on the other hand a "system of interdependence" that is inextricably linked to others to achieve these wantss. Civil society has systems such as judicial, welfare administration and coporation to address internal risks and contradictions. However, this universal state function of the minimum state theory is being sought more actively in the state in its original sense. Welfare administration is linked to sovereignty, and coporation are linked to legislative power. The state Hegel talks about presupposes the separation of powers, but at the same time is based on organic harmony and unification of powers. The monarch is at the height of this unification. While the civil society is ‘mechanically united’, the state is ‘organically united’ as the life. Hegel's state is largely characterized by organic state and constitutional monarchy. In order to enable organic unification of the three powers, communication and mediation between the three powers are important. Hegel describes this role through the Legislature. Hegel's constitutional monarchy, on the one hand, is a demand for the sovereignty of modern powers, and on the other hand, law restrict its function and role. However, some point out that allowing a monarch to inherit by natural birth does not conform to Hegel’s own principles emphasizing the ideological superiority over nature and contradicts the principle of equality and fairness of opportunities in the modern world. As a result, civil society and a state are two different countries that make up the modern world, and they work on different principles. In this sense, Goller said, "The state is dualized," and this article considers Hegel's national theory at the level of a dual state.
