Abstract
Since the mid-1990s, research related to law and emotion has been actively conducted in the United States. The reflection gained through early law and emotion studies was that it was neither realistically possible nor normatively correct to exclude emotion from legal analysis. Further, the study of jurisprudence had the task of explaining and demonstrating how the law accommodates the role of emotion. Of course, the early studies still have their limitations in terms of the descriptive aspects of law and emotion research, but they show reflections rich enough to at least prompt academic interest in the field of law and emotion. If the initial goal of the study of law and emotion was to overcome the dichotomy between reason and emotion, later research subjects begin to explore in the ‘question on the nature of emotion’ and ‘the role of emotion in law’. In this research trend, this paper intends to deal with the issue of ‘judicial emotion’ in particular, focusing on the major studies of Terry A. Maroney, who is leading the study of law and emotion in the United States. Judicial emotion is a subject that has not been explored more than any other subject in legal research, and it is not an exaggeration to say that it has been suppressed and concealed in legal decision-making. Breaking the collective silence about the influence of emotions on judgment and transparently identifying the role of emotions in judicial judgment will ultimately be an important way to gain judicial credibility. In this respect, this paper consists of following parts. Chapter II critically reviews the cultural script of ‘judicial dispassion’ that has been in the law for a long time, and what new script can replace this, and furthermore, what are the tasks for theoretical construction of judicial emotions? Chapter III explores ways to utilize emotions for better judicial judgment through the emotional participation model proposed by Terry A. Maroney. Finally, in Chapter IV, the necessity of research on judicial emotions and future tasks is pointed out.
