Abstract
Due to the continuous droughts and serious water shortages in recently years, the necessity of integrated water management system, particularly focusing on the development of alternative water resources as well as the systematic and efficient management of existing water resources, has been emphasized for stable supply, use and management of water resources. In this regard, as an economical and efficient means of alternative water resources, the technology of ‘aquifer storage and water quality enhancement’ has been noted in Korea because it has been recognized as one of the best ways to achieve the core policy goals of integrated water management system. In this context, in Korea, studies have been performed to develop the technology and legal institution of ‘aquifer storage and water quality enhancement’ by Research Team of Aquifer Storage and Water Quality Enhancement supported by Korea Agency for Infrastructure Technology Advancement (KAIA). According to the research, although there are several relevant Acts and subordinate statutes in Korea, both the legal basis and the policyㆍinstitutional foundation for the technology and project are very weak and unclear. Most importantly, the recognition and understanding concerning the technology and project are not yet fixed into the relevant existing legal system. Based on this perception, the main purpose of this article is to provide a foundation of discussion for the most suitable approach to establishment of legal institution for the ‘Project of Aquifer Storage and Water Quality Enhancement’ in Korea. In order to achieve this goal, this article begins by reviewing the legal concept and scope of ‘aquifer storage and water quality enhancement’ (Chapter Ⅱ); then reviews the relevant existing legal system in Korea (Chapter Ⅲ) and several leading cases of legal institutions in major foreign countries (Chapter Ⅳ); and conclusively analyzes and suggests realistic and appropriate approaches to establish the legal institution for the ‘Project of Aquifer Storage and Water Quality Enhancement’ in Korea. The authors, through more detailed and comparative considerations on the leading cases of legal institutions as stated in this article, expect that the successive works will be effectively progressed to establish the legal institution of the ‘Aquifer Storage and Water Quality Enhancement Project’ in Korea.
