Abstract
In the modern era of globalization, immigration has been politicallycontroversial in many advanced market-economy countries. Largemajorities in all these countries would prefer fewer immigrants. Butmany advanced market-economy countries continue to accept newentrants. By means of the principle of national sovereignty, states havethe acknowledged right to determine who enters their borders. Accordingto international rules,“ a state has the competence to control and toregulate the movement of persons across its borders.” Thus, states definethe number of individuals they will permit to enter, the characteristics ofthose individuals and the conditions associated with their entry throughtheir immigration control policies. However, this right is not absolute. It is limited by the right ofindividuals to move across borders among other reasons. Citizens of astate have the broadest right of entry. On the other hand, non-citizenshave only limited rights of entry, established in international andmunicipal laws to varying degrees. They encompass the right of an aliento join a citizen family member, the right of a resident alien to be joinedby his or her family, the right of an alien to seek asylum from a wellfounded fear of persecution and the right to not be expelled from thestate. Each of these rights may constrain the state from controlling andregulation the movement of persons across its borders. Family reunification comes from the right of individuals to marryregardless of nationality, the protection of the family unit as the basicunit of human society, the right of the child to be united with his or herparents and the right to leave one’s country. Many internationalcovenants, treaties and declarations pertain to the right to familyreunification. But the right of family reunification itself is not enshrinedin international covenants. At best, governments are exhorted to facilitatefamily reunification. Now Governments including Korea need to enshrinethe right to family reunification in immigration law.
