Abstract
This article reveals that the current Korean family immigration system has a stratified structure in which the scope of family, the length of stay, and other conditions for which family members of migrants are allowed vary widely, according to the migration status of sponsors. Notably, the stratified family migration system effectively excludes family members of low-skilled migrant workers through the legal gap in family visa, and thus causes involuntary family separation. The family migration system thereby fails to guarantee the right to family reunification under the international human rights law and the Constitution. It rather shows that Korean government intends to discriminate foreigners based on their skill-level and ethnicity and controls the “unfavorable” groups for the benefit of national economy. Such family migration system ignores the fundamental nature of the right to live with family as a universal human right and is not in line with the recent agreements made in the international community through the United Nations Global Compact for Safe, Orderly and Regular Migration. This article argues that the current migration system, which forces family separation of low-skilled migrant workers, cannot be justified under the guise of ‘short-term circulation system’ or ‘principle of no settlement’ when the actual length of stay may reach almost 10 years. Neither the reason for being in manual job nor the fact that they are not Korean descents can justify discrimination in their enjoyment of the right to family unity. Rather, such system seems to reveal underlying racism against foreigners based on the economic status of their countries of origin and preference of Korean ethnics. This article proposes that the family migration system be revised to provide equal protection of the right to family reunification for low-skilled migrant workers and all migrants who are living as members of Korean community.
