외국인 강제퇴거제도와 인권문제

국제법상 외국인을 추방할 수 있는 권리는 체류국의 고유한 권리이지만 절대적인 것은 아니고 국제인권법의 제한이 따른다. 즉 국가는 외국인을 자의적으로 추방할 수 없고, 국내법에 규정한 추방사유에 해당하여 부득이하게 추방하더라도 외국인의 인권은 보호되어야 한다. 그러나 우리나라에서 현재 시행되고 있는 강제퇴거제도는 외국인의 인권보호에 있어 소홀한 부분이 존재하는데, 이로 인하여 강제퇴거를 당하는 외국인의 이익이 침해되는 부당한 결과가 초래되게 된다. 이 논문에서는 외국인의 강제퇴거에 따른 인권침해문제로 보호기간문제, 강제퇴거명령에 대한 이의신청문제, 가족결합권의 보장문제, 외국인근로자의 체불임금문제 등 4가지 문제를 검토하였고 그 해결방안을 다음과 같이 제안하고자 한다. 보호기간문제에 있어서는 현행법의 합리적인 선에서 보호기간의 상한을 규정하고, 또 행정기관의 권리남용을 견제하기 위하여 보호기간 연장의 승인기관을 행정기관이 아닌 법원으로 정하는 방법을 제안하였다. 강제퇴거명령에 대한 이의신청권문제에 있어서는 그 해결방법으로 해당 외국인이 법원에 강제퇴거명령의 집행정지를 신청하였을 경우에는 그에 대한 법원의 결정이 나올 때까지 일시적으로 집행정지할 것을 제안하였다. 가족결합권의 보장문제에 있어서는 사전적 보호방법으로 강제퇴거명령을 발부여부를 결정함에 있어 고려사항으로 가족결합권, 특히 아동의 이익을 필수적으로 고려할 것을 제안하였다. 체불임금문제에 있어서는 고용노동부 공무원의 ‘선처분, 후통보’를 허용하도록 <출입국관리법 시행령>을 개정하고, 체불임금에 대하여 민사소송을 진행하는 경우에는 대한법률구조공단의 조력을 받을 수 있는 제도의 마련을 제안하였다.
Abstract
A state have the right to expel aliens in international law. But it is not a absolutely discretionary right, but should be subject to some restrictions demanded by international humanitarian law. In other words, a state can not expel aliens in the way where infringe on his human rights protected by international law. But some instances where does not protect the human right of the person due for the forced removal are found in the present Korean forced removal system under the <Immigration Control Law>. This paper points out several issues of human rights violations within this ambit; for example, issues on the period of immigration detention, objection of forced removal order, protection of the right to family unity, and immigrant worker's overdue wage. In order to find the solution of such problem this paper basically considers of the balance between the national interests drawn from national sovereignty and personal benefit should be protected by international humanitarian law. As the solution of issues on the period of immigration detention, this paper suggest to define the upper limit period of immigration detention under the <Immigration Control Law>, or define court to decide the extension of the period of the detention in order to prevent possible abuses by the administrative authorities with respect to the length of the detention of an alien subject to remove. As the solution of issues on the objection of forced removal order, this paper suggest to suspend removal alines who request suspension of execution to the court, until the court make a decision about the request. As the solution of issues on protection of the right to family unity, this paper suggest to consider the right to family unity, especially the interests of the child requisitely, when the head of the branch office or sub-branch office or immigration detention center make a decision to remove the alines. As the solution of issues on immigrant worker's overdue wage, this paper suggest to amend the <Immigration Control Law Enforcement Decree> to allow the Ministry of Employment and Labor officers to notify the illegal alien to the immigration office after settling immigrant worker's affairs. And in order to protect the immigrant worker who brings a civil action, this paper suggest to build a system to get assistant from Korea Legal Aid Corporation. These solutions will more effectively protect the human rights of the person who will be and is removed.
