현재 우리사회에 확산되어 있는 불법 사행산업은 규모면에서 결코 무시할 수 없을 정도로 많은 것으로 추정되고 있으며, 질적인 측면에서는 스마트폰이나 인터넷 등을 통한 신종수법이 기승을 부리고 있어서 단속이 점점 어려워지고 있다. 또한 개인 간에 은밀하게 행해지던 불법 사행산업이 최근에는 온라인 등을 통하여 다양한 사기범죄의 온상이 되고 있으며, 조직폭력배 등과 연계된 불법 스포츠베팅이 확산되면서 스포츠 승부조작 및 각종 폭력사건과 연관되는 등 사회적 해악의 정도도 이미 도를 넘어서고 있다. 그럼에도 불구하고 현재 사행산업통합감독위원회 등을 통하여 제공하고 있는 불법 사행산업에 대한 공식통계자료는 우리사회에 불법 사행산업의 실태와 규모를 인식할 수 있는 분명한 수치를 제시해주지 못하고 있으며, 불법 사행산업규모에 대하여 약 53~88조원으로 추정하고 있을 뿐, 불법 사행산업으로 인한 탈세 및 부당이득에 대한 실질적 자료는 전무한 실정이다. 결국 이러한 실태분석의 미흡으로 인하여 불법 사행산업을 단속ㆍ처벌하기 위한 종합적인 대책을 효과적으로 제시하지 못하고 있다. 이에 본 연구는 불법 사행산업문제를 개선하기 위해 관련 실태를 다양한 자료들을 활용하여 분석하고, 이러한 분석결과에 기초하여 실효성 있는 정책들을 제시하고 있다.
Abstract
Currently, it is estimated that illegal gambling industry is so prosperous and never ignored in terms of the scales. The law enforcement faces difficulties to control it since it is getting increasingly intellectualized with new techniques through smart phones and the internet. Illegal gambling was underground activities which were performed privately, however, it becomes various forms of fraud hotbed via online and expands to illegal sports betting associated with organized crime groups to the extent of social harms that have overreached. The statistics for the illegal gambling industry does not provide the exact figures of the illegal gambling to recognize the trends and the scales in our society. It is estimated about ￦53 trillion to ￦88 trillion in the illegal industry, yet there is no practical data about tax evasion and enrichment of the illegal gambling industry. As a result, it is hard to suggest the comprehensive policy alternatives effectively to crack down and regulate the illegal gambling industry due to the lack of relating analysis. Therefore, this study acknowledges the concept and the types of illegal gaming industry on the basis of literatures and analyzes the reality of the illegal gambling industry using statistics from the Korea Racing Association and the National Gaming Control Commission and media reports. Based on the findings effective regulations would be suggested.
