영국의 민간위탁법제에 대한 연구

초록

행정사무를 국가나 지방자치단체 이외의 법인, 개인에게 위탁하여 처리하는 민간위탁은 그동안 수탁기관 선정의 부적절, 독점위탁의 관행적 장기화, 수탁기관 관리감독의 부실 등 다양한 문제점이 지적되어 왔다. 이러한 문제점을 극복하기 위해서는 ‘행정능률의 향상’과 ‘행정사무의 적정성과 책임성의 확보’라는 두 가지 목표를 조화시키는 민간위탁법제를 정립하는 것이 중요하다고 할 수 있다. 이를 위해서 이 글에서는 영국의 민간위탁법제를 검토함을 통해 우리나라에의 시사점을 찾아보았다. ‘1994년 규제완화 및 민간위탁법’(Deregulation and Contracting Out Act 1994) 및 관련법령을 토대로 한 영국의 민간위탁법제는 다음과 같은 특징을 가진다. 우선 행정능률의 향상을 위해서 1) ‘성과를 기반으로 한 위탁’(outcomes-based commissioning), ‘결과를 기반으로 한 대가지급’(payments-by-results), ‘포괄위탁’(black box commissioning) 등 다양한 혁신적인 민간위탁계약방식이 활용하고 있으며, 2) 사업자선정을 하는 과정에서 다양한 평가제도들을 둠으로써 행정능률을 향상할 수 있는 최적의 사업자를 선정할 수 있는 있는 틀을 마련해놓고 있고, 3) 사업자 선정과정에서 최대한 경쟁을 활성화하고자 노력하고 있다. 다음으로 행정사무의 적정성과 책임성을 확보하기 위해서 1) 특정사무를 민간위탁하기 위해서는 일정한 행정입법의 제정절차를 거치도록 함으로써 민주적 정당성을 확보하도록 하고, 2) 법률에서 일정한 사무에 대해서는 민간위탁을 금지하고 있으며, 3) 사무수행과 관련하여 행정주체가 개입할 수 있는 여지를 마련해둠으로써 책임성을 확보할 수 있는 장치를 마련해놓고 있다. 위와 같은 영국의 민간위탁법제는 「행정사무 민간위탁에 관한 법률」(안)의 도입을 통해 ‘행정능률의 향상’과 ‘행정사무의 적성성과 책임성의 확보’라는 두 가지 목표를 조화시키고자 노력하고 있는 우리나라에 여러 가지 시사점을 제공하는 것으로 보아야 할 것이다.

Abstract

Korean regime on commissioning of governmental functions to private parties has been criticized for inadequate choice of service providers, monopoly of this market, and lack of monitoring of this commission. To address these issues, it is critical to establish legal system of commissioning to private parties in balancing between “efficiency of administration” and “appropriateness and accountability of administration”, To this ends, this paper sees United Kingdom (UK) law, and find some implications therefrom. UK’s contracting-out regime, based on ‘Deregulation and Contracting Out Act 1994’ and other related Acts and regulations, have following characteristics. To achieve “efficiency of administration”, UK uses innovative contracting method such as “outcomes-based commissioning”, “payments-by-results”, “black box commissioning”, implements various evaluation regime in procurement process, and makes efforts to strengthen competition in choosing providers. Meanwhile, to achieve “appropriateness and accountability of administration”, UK requires parliament’s approval for contracting-out “Ministerial Order” thus guaranteeing democratic legitimacy, excludes some governmental functions are explicitly excluded from being contracted-out, and allows government to step-in functions which are contracted out. UK regime which tries to balance “efficiency of administration” and “appropriateness and accountability of administration” shows many lessons to Korea, which are making effort to harmonize these two objectives through adopting “Act on the Commissioning of Governmental Functions to Private Parties”.
