Abstract
Since 1980s, under the banner of “New Public Management”, there has been a growing tendency in the United Kingdom to contractualisation of relations between public bodies and the society, as well as among public bodies themselves. Procurement, private finance initiative, contracting out of some public duties, concessions are the main types of ‘government by contract’, but internal contracts, such as framework document between sponsoring departments and next-step agencies, public service agreements, and NHS contracts are also remarkable examples which show a dramatic changes in regulatory methods in modern administration. The rise of government contracts in the sense of the exercise of dominium as distinct from imperium subjects public law lawyers to a harsh task of reconstructing public law systems. For example, the problem of legal enforcibility of internal contracts could result in debates about the concept of contracts itself. The relation of government contracts and parliamentary legislation is especially ambivalent. Authorizing statute would facilitate the government’s contractual activities, in that it provides the government the power to enter into contract, enhancing the democratic accountability of government and predictability of the parties’ rights and duties. At the same time, statutes which govern the government contract provide the standard to courts, available in the context of judicial review, that is, statutes works as a measure of controlling the government contractual activites, in the other way. We could enhance the political and legal accountability of government by requiring that every government contract should be well founded by pre-existing statutes, but in doing so, we can also hamper the flexibility and efficiency which contractual course has noticeable advantage. To sum up, how to establish the desirable relation of government contract and legislative statutes, how to enhance the political and legal accountability of government contractual activities, and how to modify the private law theory of contract in the public law context, are the main issues of the current administrative law debates in the United Kingdom. We can get some insights from the preceding discourses and efforts of administrative law of the United Kindom on government contracts.
