인지과학적 관점에서 바라본 자유의지와형사책임론의 문제

초록

이 글에서 발표자는 오랜 역사를 가진 자유의지논쟁 속에서, 뇌과학적 연구결과가 가져다 준 일련의 충격과 그에 대한 인문학 진영에서의 반격, 철학적 고찰을 소개하였다. 뇌과학 진영에서는 인간의 정신현상이 단순한 신경프로세스적 현상에 불과하다는 점을 여러 실험을 통해 주장하였다. 자유의지가 환상에 불과할지도 모른다는 뇌과학 연구결과는 많은 이들에게 충격을 던졌고 유물론적 환원주의자들은 자유의지를 부인하기에 이르렀지만, 자유의지의 논쟁은 여전히 진행중이다. 그러한 뇌과학적 연구결과가 위협적이기는 하지만 규범과학적 입장에서의 자유의지는 부인될 수 없을 것으로 본다. 자유의지를 부인할 수 없는 이상 인간의 행위에 대한 윤리적 책임은 부정될 수 없을 것이다. 그러나 규범과학이 뇌과학의 연구결과를 전혀 외면할 수만은 없다. 인간의 자유의지가 오히려 본능과 감성의 영향에 결정적으로 복종하고 있음과 인간의 자유의지가 인간의 정신을 담고 있는 몸과 그를 둘러싼 환경에 지대한 영향을 받고 있음을 인정하게 된다면, 인간의 자유의지를 전제로 하여 책임을 비난가능성으로 파악하는 도의적 책임론의 방향은 다소 수정될 수밖에 없다. 발표자는 형벌에서 비난의 뉘앙스를 자제할 필요가 있다는 문제의식을 제기하였다. 이에 따라 형벌론을 논함에 있어 보다 객관적인 시각이 도입될 필요가 있다고 할 것이고, 범죄에 대한 책임은 범죄자 개인과 국가사회가 나누어 져야 할 것이다.

Abstract

The Note is introducing, some impacts from researches of brain science on the dispute with long history on human free will, and counter-argument of humanistic science. The brain science has been arguing through many experiments that the phenomenon of spirit is only that of neural process. The result of researches that free will may be only illusion, cast impacts on many people, and some materialistic reductionists denies the concept of free will. But disputes on free will are still going on. Such researches of brain science are threatening but the concept of free will in view of normative science won’t be able to be denied. As far as we cannot deny free will of humankind, ethical responsibilities for human activities also cannot be denied. But normative science shouldn’t entirely neglect the researches of brain science. If, however, we can admit the fact that, human free will is subject to influence of instinct and sentiment and it is influenced from bodies containing human spirit and environment surrounding the bodies, the direction of argument of moral responsibility should be adjusted. The Note presents a critical mind that we need to constrain a nuance of blame in penalties. Thus, in the discussion about penalties, we need to import more objective view and the responsibilities for the crimes should be shared among individuals of criminals and the state.
