동물들은 인간의 생활 속에서 다양한 방식으로 이용되어진다. 물론 그것은 그들의 죽음을 전제로 하여 우리가 얻는 편익인 것이 대부분이다. 따라서 그러한 이용행위, 즉 생명을 죽음에 이르게 하는 행위 역시도 법적 근거를 가지고 정당화되어진다. 그러나 동물의 생명도 인간의 생명과 마찬가지로 같은 자연현상인 생명원리하에 놓여 있는 것일 진데, 인간에 의해 이루어지는 동물의 생명의 단축이 정당화를 얻기 위하여는 단순한 인간의 관습적, 유희적 또는 경제적인 이유 이상의 보편성을 가질 수 있는 윤리적 정당화가 요구된다. 따라서 이 글은 그러한 실정법적 정당화의 이면에는 어떠한 현실에 대한 합리화가 자리잡고 있으며, 이러한 합리화의 논변은 어떠한 논리로서 비판되어질 수 있는가를 보다 논리적인 관점에서 살펴보고자 한다. 이를 위하여, 먼저, 동물의 죽음이 인간의 죽음과 어떠한 관계에 있는지를 한국사회의 맥락에서 살펴보고, 한국법에 있어서 동물에 대한 법적 지위와 동물의 죽음을 실정법적으로 어떻게 규정하고 있는지를 개관한 다음, 이러한 현실에 대한 정당화의 논리와 다양한 비판적 논변들에 대하여 살펴보기로 한다. 특히, 다양한 비판적 논변들을 논함에 있어서는 싱어의 공리주의, 레건의 권리론과 환경윤리적 관점을 중심으로 살펴볼 것이다. 이를 통하여 인간이 동물을 대하는 방식에 있어서 보다 보편성을 가진 행위윤리를 찾고자 한다.
Abstract
Animals are used for humans lives in various ways. Mostly, it is for our benefits on the condition that they are to die. Therefore, animal usages that leads to their death are conducted based on legal justification. Yet the animal life is also controlled by natural bio-system as human life does. So, for justifying unnatural curtailment of animal life, ethically justifying with universally acceptable reasons would be required other than simple reasons based on human interests, customs, and amusements. Therefore, this article tries to answer following questions in logical perspectives: First, which rationalization for reality is underlying under the positive legal justification for animal use? Second, what critical arguments against those justification are. To carry out such topics, this research takes following steps: First, this article will discuss the relation between animal death and human life in Korean society. Second, this study will review the animal legal status in Korea and current Korean laws covering animal death. Lastly, it will analyze arguments of rationalization and critiques of its reality. Especially, when it comes to the arguments concerning the diverse critiques, this study will focus on Singer’s utilitarianism, Regan’s animal right theory, and environmental ethics. Through the above arguments, this article seeks to find the more catholic ethics on how human should deal with animals.
