Abstract
Diagnostic and Statistical Manual of Mental Disorders(DSM) is the global standard for diagnosing mental illness. Despite its preface warning of the dangers of forensic misuse, most lawsuits rely on expert diagnoses based on DSM. This paper examines the validity of psychiatric classification systems, focusing on DSM, which is the only system that deals exclusively with mental illness and is therefore at the center of controversy. How has DSM-5 become an entrenched black-box and how should it be translated in the courtroom? What are the sociotechnical imaginaries of the courts regarding human mental illness? We need to explore how DSM can be reliably integrated into the network of litigation. Grounded in the perspectives of STS studies, this paper draws on discussions of DSM that span psychiatry, neuroscience, psychology, sociology, and forensic science to deconstruct DSM as a medical authority and an entrenched black-box. It examines the problems of DSM in diagnosing mental illness from the perspectives of medicalization and medication tendencies, superficial classification of symptoms, biological bias, social construction of diagnostic categories, cultural bias, and limitations of the botanical model. Then it examines the problems of using DSM for forensic purposes in particular from the perspectives of objectives, clarity, and litigation structure, showing that DSM is a hybrid network rather than an established medical knowledge to be directly absorbed into the courtroom. Based on this, we categorize the types of cases in which DSM has been cited and analyze the precautions for making critical use of DSM-5 to meet the individual needs of each case. In order to arrive at a judgment that is specifically relevant to a single individual, given the legal ideology, personal narrative, and social context of each case, the weaknesses of the grand theoretical assumptions of a mental illness classification system must be recognized and DSM-5 should be used in a localized context with complementary measures.
