옴부즈만의 필요성과 새로운 역할 강화 방안: 전통적 행정통제 기제의 한계와 대안 기제를 중심으로

Abstract

There are many administrative control mechanism against the executive. This study is to discuss the theoretical content, experiments, and case studies that have been dealt with in social psychology or organizational psychology as the root cause of the failure of traditional administrative control mechanism. Then, If there is not effective traditional internal control of administrative bureaucracy and administrative control by the legislature and the judiciary. In addition, as the civil society develops, the administrative control by citizens is diversified, but this also has limitations. If so, what other control mechanisms are there? Seeking the answer to the question is the goal of this study. In this context, we have been introduced ombudsman. In reality in Korea, various forms of ombudsman are in operation. However, this also raises questions about effectiveness. So, the role of the national ombudsman is reviewed in this study, and the new role enhancement of ombudsman is discussed from the various perspective: the scope, the position, and the authority of the ombudsman. In addition, this study is also to discuss about functions and factors that need to be addressed to operate the local ombudsman.
