개헌은 제헌헌법 이래 매 정권마다 주기적으로 반복되어 온 담론이라고 해도 과언이 아니다. 주요한 정치변동이 발생할 때마다 개헌에 대한 요구가 있었고, 또 실제로 개헌이 있었다. 지금도 예외는 아니다. 1987년 현행헌법이 탄생하는 데 산파역을 맡았던 3김이 정치무대에서 퇴장하자 헌법 개정의 필요성을 주장하는 시민사회단체와 학계의 목소리가 더 높아지고 있다. 그러나 이러한 개헌논의의 빈발성에도 불구하고 개헌담론은 구체성이나 대중성이 약한 것도 사실이다.이 논문은 개헌논의의 구체성을 위해 개헌이라고 하는 큰 그림의 일부분인 국회관련 개헌의 방향을 논의하고 있다. 이를 위해 의회의 유형론적인 특성, 그리고 정부형태와 의회제도의 조응성을 살펴본 이후, 이를 바탕으로 바람직한 국회관련 개헌의 방향을 조문별로 고찰하고 있다.
Abstract
Since the First Constitution has ben enacted, almost all Korean Governments repeatedly raised arguments on amending the Constitution at the time. After the Three Kims steped down from the political arena, arguments on constitutional reforms, especially, have ben strongly raised by scholars and social activists. However, the constitutional reform discourses have not yet gained details or public understandings. To give concreteness to the discourses, this paper aims to provide a constitutional draft related to National Asembly which is a small part of the whole reform. For that, the typology of legislatures as well as the relationships between types of regimes and legislatures are investigated. A desirable draft of the constitution related to National Assembly, then, is investigated section by section based on the assumption that the current presidential system is maintained.
