세계 곳곳에서는 내전과 기근 및 자연재해, 부패한 정부와 억압적인 사회문화로 인해 인권침해가 발생하고 있다. 본 논문은 이러한 인권침해에 대해 국제사회가 할 수 있는 조치인 ‘인도적 개입’을 연구 대상으로 하여 그 정당성과 논쟁점에대해 살펴보고자 한다. 국제사회의 정의관을 담은 존 롤즈의 『만민법』에 나타난 ‘인권’과 ‘인도적 개입’ 개념을 통해 인도적 개입 정책에 대해 고찰함으로써 이론적인 동시에 경험적인 연구의 함의를 갖는다. 롤즈에 따르면, 자기결정권(주권)을 가진 만민의 사회에 인도적 개입을 실시할 수 있는 근거와 정당성은 인권 존중에서 비롯되는데, 인권은 ① 관용의 한계로서, ② 자기 방어의 보루로서, ③ 원조의 정당성의 근거로서 역할을 한다. 또한 인도적 개입은 ① 관용의 한계를 넘어서는 인권침해에 대한 개입이 전 지구적 차원의 구조적 문제를 간과할 수 있다는 점, ② 인도적 목적의 무력 개입에 국제정치적 변수들이 상당한 영향을 미칠수 있다는 점, ③ 정치문화와 제도의 이식을 요구하는 원조는 수혜국의 빈곤화를가중시키고 자생력을 저해시킬 수 있다는 점에서 논쟁점을 갖는다.
Abstract
Various cases of human rights violation occur around the world. Uponthe cases, global society including individual states, international organizations,and INGOs have tried to make a 'humanitarian intervention' to a certain state. This is, the protection of human rights is generally conceived as the justificationof the intervention of state sovereignty. The primary purpose of this paper is toexamine the justification of and controversy over humanitarian interventionpolicy. In particular, it focuses on the concepts of 'human rights' and'humanitarian intervention' proposed in John Ralws's The Law of Peoples. According to Rawls, humanitarian intervention is justified when human rightsplays a role as ① the limits of tolerance, ② the bulwark of self-defense, and③ the standard of international aid. This paper, however, finds that such pointsof justification carry several controversies. ① Humanitarian intervention beyondthe limits of tolerance is likely to overlook global structural problems. ②International political factors can make a considerable influence on humanitarian'armed' intervention. ③ International aid, which aims to implement politicalinstitutions and culture, would exacerbate poverty and also impede the stateautonomy of recipient countries.
