세계자본주의의 발전과정에서 가속화되고 있는 세계화의 추세는 인권문제에 있어서도 과거와는 다른 국면들을 나타내고 있다. 국가 간 상호의존성이 증대되면서 한편으로는 인권의 국제화가 확산되고 있으며, 다른 한편으로는 인도주의적 개입의 정당성 문제를 둘러싼 논란이 심화되고 있다. 본 논문은 인도주의적 개입의 문제를 전면에 떠오르게 만드는 시대적 배경으로 인권의 국제화와 이를 추동하는 경제적 맥락을 분석하고, 이를 토대로 인도주의적 개입의 정당성 문제에 대한 상반된 관점들을 검토하며, 나아가 이들 관점들의 문제점을 지적하고자 한다. 마지막으로 본 논문은 현 단계에서 인도주의적 개입의 정당성 문제를 해결하기 위해 요구되는 몇 가지 사항을 검토하고 향후 인도주의적 개입문제가 어떻게 전개될 것인지 그 추세를 전망해보고자 한다.
Abstract
The current of globalization accelerated by the development of world capitalism brings forth a new tendency in the human rights issues that is quite different from the past. Along with the increasing interdependence among nations, on the one hand, the internationalization of human rights is expanding and, on the other hand, the controversy over the legitimacy of humanitarian intervention gets to hot up. The paper gives an overview of the economic context that activates the internationalization of human rights and the humanitarian intervention, examines the opposing perspectives on the legitimacy of humanitarian intervention, and points out the problems of each perspective. The paper also tries to inquire into some urgent requirements for the solution of the legitimacy problem of humanitarian intervention and put forward a conclusive outlook for the future of the legitimacy problem.
