인도주의적 개입에 대한 고찰과 도덕교육적 함의

인도주의적 개입은 주권원칙, 불개입원칙, 무력사용 금지 원칙에 기초하고 있는 국제사회에 근본적인 도전을 제기해 왔다. 자위권(right of self-defense) 행사를 제외하고 UN 헌장에 따라 안전보장이사회(Security Council) 의 결정에 따르지 않는 무력 사용은 엄격하게 금지되어 있다. 특히 ‘주권이 우선인가’ ‘인권이 우선인가’의 문제는 현재의 국제법 체계 하에서 뜨거운 쟁점이 되어 왔다. 그러나 2001년 ICISS의 보고서에서 보호책임(R2P)의 개념이 등장한 이후 UN은 대량학살(genocide), 전쟁범죄(war crimes), 인종청소(ethnic cleansing), 반인륜적 범죄(crimes against humanity)에 대한 책임을 다하지 않은 국가에 대한 인도주의적 개입을 정당화하였다. 국제사회의 이러한 변화의 모습은 인권의 중요성을 강조하고 있는 것으로 파악되고 있지만, 실제로 국제사회가 이에 모두 동의하고 있는 것은 아니다. 이에 이 연구에서는 인도주의적 개입과 관련된 쟁점들을 살펴보고 도덕교육에의 시사점은 무엇인지 고찰해 보고자 한다.
Abstract
Humanitarian intervention has raised fundamental challenges to the international community based on the principle of sovereignty, non-intervention, and non-use of force. The use of force against other states that do not comply with the decisions of the Security Council under the UN Charter is strictly prohibited to the exclusion of right of self-defense events. Especially, the issue of 'sovereignty first' versus 'human rights first' have emerged as a major interest under the contemporary international law system. Nonetheless, the United Nations has been justified humanitarian intervention to states that did not fulfill their responsibilities to genocide, war crimes, ethnic cleansing, and crimes against humanity since the concept of responsibility to protect(R2P) emerged in ICISS's report in 2001. It is understood that such changes in the international community emphasizes the importance of human rights, not every international community agrees with this approach. So this study will be examined issues related to humanitarian intervention and examine the implications for moral education.
