아동학대의 영향은 신체적, 심리학적으로 심각하고 오래 지속될 수 있다. 또한 학대 피해는 특히 아동기의 경우, 이후 학대행위자가 될 요인의 가능성이 있다. 아동학대는 지역사회 문제이며, 학대로부터 아동을 보호하는 것은 지역사회의 책임이다. 우리나라는 아동학대에 대처하기 위하여 여러 제도적 노력을 벌이고 있으나, 아직 부족한 것이 많다. 미국은 1912년 연방 아동국의 창설 이후 아동의 발달과 복지 관련 현안을 발전시켜 왔다. 이에 본 연구에서는 미국의 아동학대 보호 및 지원 제도를 중심으로 한국의 발전방안을 제시하였다. 첫째, 다자간 종합 지원체계의 강화이다. 어떤 단일한 기관도 아동학대에 대한 효과적인 개입권한을 가지지 않는다. 가장 효과적인 지역 사회 대응은 관련된 모든 전문가들이 각자의 역할과 책임, 강점과 약점을 이해하고 협력할 때 가능하다. 둘째, 아동 보호 및 지원에 관한 역할을 구분하고 정보를 공유하는 것이다. 셋째, 아동학대 피해자 보호를 위한 사안에 한하여 아동보호전문기관의 권한을 확대할 필요가 있다. 넷째, 아동학대 사건의 재판과정에서 당해 소송에 관한 후견인을 의무적으로 선정할 필요가 있다. 후견인은 적당한 교육을 받은 변호사로 지정되어야 한다. 다섯째, 미국은 모든 주에서 신고 의무를 규정하고 있으며, 신고에 따른 여러 면제 규정을 두고 있다. 적극적인 신고 활성화를 위해 신고의무자 확대, 신고의무 위반시 처벌 강화, 신고의무자 교육 및 홍보 강화 등이 필요하다. 마지막으로 가족의 특성에 따른 지원이 필요하다. 이를 위하여 부모나 가정이 갖고 있는 여러 가지 위기상황에 대한 개입, 위기대처능력 강화에 대한 지원이 요구된다.
Abstract
Although there are a number of institutional activities respond to child abuse in Korea, it seems to be not enough. With creation of the federal Children’s Bureau in 1912 in the United States, there have been developed on the issues about child development and welfare. Accordingly, this study offers development strategy for Korean system focusing the protecting and supporting victims of child abuse in criminal procedure in the United States. First, it needs to be reinforced by a multidisciplinary respond. Second, it needs to define roles according to each agency mandate and share information associated with child abuse cases. Third, there is a need to expand the rights of Child Protection Agency only for protecting victims of child abuse. Fourth, there is a need to appoint a guardian ad litem obligatory to represent the child’s best interests in every case of abuse that results in a judicial proceeding. Fifth, It needs to expand mandatory reporters, strengthen punishment in case any person who shall knowingly fail to make the report required by law, and reinforce of public education and public relations. Lastly, it needs to assist family depending on quality.
