노인 운전자의 교통사고율이 증가하면서 도로의 안전을 확보하기 위해서는 국가가 노인의 운전을 제한해야 한다는 주장이 나오고 있다. 이글은 첫째, 이런 주장이 나오게 되는 배경을 살펴보고 핵심 쟁점을 소개한다. 둘째, 여러 쟁점들 중에서 노인의 운전을 제한하는 것은 일종의 연령차별주의에 해당하며 헌법이 보장한 평등권의 위배라는 주장을 집중적으로 다룬다. 셋째, 이 문제를 단순히 권리와 평등의 문제가 아니라 더 넓은 사회적 맥락에서 보아야 한다는 점을 주장할 것이다. 노인의 운전은 개인적 차원에서 이루어지는 것을 넘어 사회적 차원에서 이루어지는 집합적 성취이기 때문이다. 이런 관점에서 노인의 운전을 제한하는 배타적 접근이 아니라 노인의 운전을 보다 안전한 방향으로 유도하는 보정적 접근이 필요하다고 주장할 것이다.
Abstract
As the traffic accident rate among elderly drivers increases, there are arguments that the government should restrict the driving of elderly drivers in order to ensure road safety. First, this article examines the background of these claims and introduces key issues. Second, among many issues, it focuses on the argument that restricting the driving of elderly people is a form of age discrimination and a violation of the right to equality guaranteed by the Constitution. Third, I will argue that this issue should be viewed in a broader social context rather than simply as a matter of rights and equality. This is because driving for the elderly is not only accomplished at an individual level, but also is a collective achievement accomplished at a social level. From this perspective, I will argue that rather than a exclusive approach that restricts the driving of the elderly, a compensatory approach that guides the elderly's driving in a safer direction be needed.
