Abstract

The purpose of this paper is to suggest a theory of justice concerning disability, which is not only justifiable from an ethical perspective, but is also feasible for removing injustice from disability. I examine two prior theories of justice on disability: a contractarian theory based on John Rawls’s theory of justice and a non-contractarian theory based on Martha Nussbaum’s capabilities approach. While Rawls’ approach is prevailing, his theory tends to result in injustice. This is because it excludes individuals with disabilities from the process of justification, defining that a contractor should have the cognitive ability to enter into a contract, which many individuals with cognitive disabilities lack. In addition, because it considers individuals with disabilities as recipients of distributive justice, the theory considers such individuals as inferior and dependent upon the distribution process. At the same time, despite non-contractarian features, Nussbaum’s capabilities approach excludes individuals with disabilities from the justification process and considers such individuals as inferior and dependent. This is because Nussbaum proposes a list of capabilities for justice, which is not justifiable for its tendency toward essentialism. In addition, this is because it considers the metric of justice as a functioning, which results in paternalistic distribution, rather than capability as freedom. Despite some limitations and problems, the capability approach has some merit for a theory of justice concerning disability when it comes to the perspective of interdependent personhood and human diversity, the priority of capability as freedom, etc. Thus, I suggest a theory of justice concerning disability based on a revised version of the capabilities approach. This theory, which respects individuals with disabilities without exclusion, would help realize an ideal and just society for such individuals, guiding a social system and culture to be favorable toward individuals with disabilities through a gradual process.
