통합진보당 이후의 진보: ‘민주적 공화주의’의 시각

이 글은 헌법재판소에 의해 통합진보당이 강제 해산된 사건이 한국 진보정치에 어떤 교훈을 남겼는지를 정치철학적 수준에서 성찰해 보고 한국 진보정치가 새롭게 나아가야 할 방향을 모색해 보려는 한 시도를 담고 있다. 이 글의 기본 시각은 모든 시민의 ‘존엄의 평등’이라는 원칙 위에서 ‘민주주의적 정의’라는 가치를 핵심 축으로 삼아 대한민국이라는 민주공화국의 이념에 대한 최선의 해석과 그 실현을 지향하는 ‘민주적 공화주의’다. 이 시각에서 보면 자칭 진보 정당이 헌법재판소에 의해 위헌 정당으로 규정되도록 빌미를 제공할 정도로 ‘헌법애국주의적 실천’을 소홀히 한 것이 지금까지의 한국 진보정치의 가장 치명적인 한계다. 통합진보당 이후의 새로운 진보정치는 무엇보다도 바로 이런 성찰 위에서 다름 아닌 민주공화국의 이념을 축으로 그 새로운 정체성을 확립하고 정치적 활로도 찾아야 한다. 이 글은 우선 우리 사회에서 주사파가 진보정치에서 목소리를 키울 수 있었던 특별한 배경을 비판적으로 조명하면서 한국의 진보정치가 주사파의 실패에서 무엇을 배워야 하는지를 규명하는 데서 시작한다. 여기서 우리는 진보정치의 핵심 축을 민주주의와 민주공화국이라는 헌법적 이념에 대한 헌신에 두는 어떤 패러다임적 전환의 필요성을 새삼 확인할 수 있을 것이다. 그러나 헌법에 대한 헌신을 이렇게 강조하는 것은 결코 그 자체로 이번의 헌법재판소 판결을 포함하여 기존의 헌정적 질서를 무비판적으로 추수해야 함을 주장하는 것은 아니다. 이런 맥락에서 다음으로 이 글은 참된 헌법애국주의는 오히려 그런 판결 같은 것을 민주적-해석적 쟁투의 대상으로 삼아 진보적 정치 공간을 열어야 함을 지적하면서 그 규범적-정치적 초점을 분명히 한다. 여기서는 이번 통합진보당 해산 판결의 정당화를 위해 동원된 ‘방어적 민주주의’ 개념이 비판적으로 검토된다. 마지막으로 이 글은 이와 같은 헌법애국주의적이고 민주적-공화주의적인 진보정치가 ‘87년 체제’라고 불리는 지금의 헌정 질서와 정치적 국면 속에서 구체적으로 어떤 지향으로 표출될 수 있을지를 논의한다.
Abstract
This article is an attempt to reflect the event of dissolution of UPP(The United Progressive Party) by the constitutional court of South Korea and to seek the new direction of Korean progressive politics at the level of political philosophy. It’s leading perspective is ‘democratic republicanism’, which attempt the best interpretation and realization of the ideal of the Korea’s democratic republic on the basis of the principle of ‘equality of dignity’ of all citizen. It’s core value is ‘democratic justice’. From this perspective the most fatal limit of Korean progressive politics is the lack of its praxis of ‘constitutional patriotism’. Therefor the new progressive politics after UPP must find a new political identity and way out of the crisis with the ideal of the democratic republic. This article starts from the critical examination of the special reason why the so-called ‘Juche-thought fraction’ could take the political lead in the progressive camp of Korea. This will show the need of the paradigm shift of progressive politics to the devotion to democracy and the constitutional ideal of democratic republic. But this does not mean that we must follow all of the positive constitutional order. So the next step is to show the true idea of constitutional patriotism must open the progressive political space through the contestation about the right interpretation of the constitutional principles. In this context is examined critically the idea of ‘militant democracy’ which is used for the justification of the dissolution of UPP. The last step is to discuss which political orientation new line of progressive politics of democratic republicanism with constitutional patriotism may have in the political constellation of so-called ‘'87-regime’ of Korean democracy.
