필자는 본고에서 1987년 6월 민주항쟁 이후 출범한 대한민국 헌법재판소가 ‘통합진보당 정당해산판결’의 절차과정에서 법치민주주의의 위상을 스스로 뒤흔든 부당함에 주목한다. 본고는 이러한 판결이 가능한 현실에서 소위 ‘법 지상주의’ 혹은 ‘법 만능주의’란 과대 포장된 절차적 정당화의 요청은 대한민국 민주주의의 질적 퇴보에 법의 무기가 동원되는 권력 남용에 다름 아니란 위기적 현실상황을 고발하고자 한다. 더 나아가 본고는 헌법재판소의 어떤 개혁과제가 대한민국의 법치민주주의를 공고화하는데 기여할 수 있는 실현가능한 대안들도 모색해 보고자 한다.
Abstract
In this article I note that in June 1987 the inauguration of the Constitutional Court after the Democratic Movement and the Court himself violate the injustice of democratic procedures process of the rule of law in relation to the dismission of the Unified Progressive Party. This paper is intended to accuse the present crisis of constitutional democracy. On the Possibility of this judgment of the Constitutional Court about the Unified Progressive Party in reality, the request of the so-called “law supremacy” or ‘all-round care law’ promote a qualitative degeneration of the Republic of Korea’s democracy. Furthermore, this paper has also sought to investigate whether any reforms can contribute to realization of the Constitutional Court of the Republic of Korea viable alternative to the democratic rule of law.
