Abstract
Last year, 460 refugees from Yemen came to Jeju Island. The claim that “we must drive them out of our land right now” has spread widely. Refugee issues are often handled in the context of human rights issues, above all, in the context of the right that their basic life und safety should be guaranteed. Such an approach is a very realistic and persuasive way. This approach, however, is dangerous to appeal to the kind-feeling policy in the way to say “We can drive them out, because it’s our land here. But let’s not do it, because they are pitiable.” So it easily results in the slogan "Pitiable, but our people are first”. Based on Rousseau's ‘The Origin of Inequality of Human Beings’ this article attempted to study the justification of the claim “It’s our land here.”, which is the precondition for the justification of the claim “It is our land here, so get out of here!”. If the land I have now is justly earned by an other, the other has justly gotten it from an another, and the another has justly gotten it from an another and so on, but if the original acquisition is not justified, the justification of the claim that this is my land is questionable. Rousseau insists that all land was for everyone and no one, until someone fenced the land for the first time and insisted "this is my land". He claims that the original acquisition is not justified, because he took the land from everyone. This article attempted to refute the arguments that the original acquisition is justified, which are proposed against Rousseau by liberals such as Locke or R. Nozick. I don’t claim that this rebuttal is final and definitive enough that anyone can not argue against it anymore. Perhaps there are many other ideas about the justification of ownership and borders. However, I hope that this article can serve as an enkindler to ignite the discourse on the justification of ownership and borders in relation to refugee issues. I attempted to make the justification of ownership and borders questionable, but I don’t claim that anyone should be able to live in the land that anyone desires, by removing the ownership or the border right now. I know that it can not be easily realized. I hope that we reflect on the justification of ownership and borders and become more humble, before we say to our refugees who have been driven out of the land that they live, “It is our land here, so get out of here!” or “It’s our land here”.
