영재교육 진흥법 개정의 쟁점 및 방안 탐색

본 연구에서는 미래사회 변화에 비추어 「영재교육 진흥법」에 제시되어 있는 영재교육 체제의 유효성을 평가하고, 영재교육이 확대 및 발전되면서 발생한 법령과 실제 간의 간극을 해소하여 영재교육의 효과적인 운영을 위한 개정 방향을 제안하였다. 선행연구 분석과 전문가 집단 심층면담(FGI)을 통한 개정 쟁점 도출, 현장 관계자 대상 요구조사 실시, 국회토론회 및 관계부처 의견 수렴, 전문가 검토를 통해 다음과 같은 7가지의 개정 방향을 도출하였다. 첫째, 영재의 정의 규정에 대해 미래사회에 요구되는 인재상에 부합하도록 성취와 함께 잠재력을 포함하여 재능 계발의 관점을 분명히 하였으며, 유사한 연령･경험･환경에 비교했을 때 높은 성취와 잠재력을 발휘하는 학생들로 재정의하는 개정안을 제시하였다. 둘째, 영재교육대상자 선정의 기준･방법에 대한 계획은 시도교육감이 정하고 구체적인 선정기준은 영재교육기관 규칙으로 정하는 방안을 제안하였다. 셋째, 소외계층 지원 근거를 마련하고자 소외계층 영재교육대상자에 대한 경제적･교육적 지원방안 마련을 의무화하고, 소외영재의 선정 기준을 현실에 부합하도록 제안하였다. 넷째, 법령과 현실과의 괴리를 극복할 수 있도록 영재교육 학급 당 학생 수의 변경을 제안하였다. 다섯째, 영재학교의 학교급에 대한 법과 시행령 간의 법체계 불일치에 대한 문제를 제기하고, 실질적인 개정은 영재교육 현장의 요구와 합의가 분명해진 상황에서 이루어질 필요가 있음을 제안하였다. 여섯째, 영재학교 교육의 효과성 제고 및 질 관리 체제 마련을 위해 지정 당시의 설립 목적 달성 여부를 점검하여 평가를 실시할 수 있도록 하는 법적 근거의 마련을 제안하였다. 일곱째, 영재학교의 법적 지위를 명확히 하기 위해 타법률인 「초･중등교육법」이 규정한 학교의 종류에 영재학교를 추가하여 학력 인정 근거를 마련하였다.
Abstract
This study propsed a direction for the revision of the Gifted Education Promotion Act to evaluated the validity of the gifted education system against future social changes and to reduce gaps have formed between the legislation and the reality, as gifted education expanded and developed, and to operate gifted education effectively. We analyzed previous studies and conducted focus group interviews (FGI) with groups of professionals in order to identify areas of the law that need to be amended, conducted a demand assessment on issues which are raised in gifted education practice, held a public hearing at the National Assembly and undergoing review by relevant government departments and professionals. The main amendments suggested by this study are as follows. First, this study clarified and enlarged the definition of the gifted from the perspective of talent development by including potential as well as achievement and embracing diverse students from under-represented subgroups. Second, we propose the master plan for the selection and criteria for the selection of gifted education targets was decided by the Superintendent of Education, and the specific selection criteria were determined by the gifted education institution. Third, we proposed a compulsory regulation on educational support measures for gifted students who are disadvantaged and different selection criteria for disadvantaged gifted students. Fourth, to resolve the disparity between legislation and practice, we have proposed an amendment adjusting the gifted class size reflecting changed educational practice. Fifth, we bring up the issue of adequacy of the levels of the gifted school which is currently limited to high school level, and suggested the actual revision needs to be done when social consensus is fully established. Sixth, we also proposed the legal grounds for an evaluation of gifted schools to enhance the effectiveness of the education of gifted schools and provide a quality management system. Seventh, we raised legal ground issue of the relationship between general education and gifted education.
