동물윤리의 주요 쟁점에 대한 덕 윤리학의 응용 방안에 대한 연구

이 논문은 인간이 동물을 이용하고 대우하는 방법에 대한 반성적 고찰을 통해 동물을 대우하는 올바르면서도 실천 가능한 방법이 무엇일 수 있는지에 대해서 검토한다. 이를 위해 먼저 동물들과 관련해서 생겨나는 여러 가지 윤리적 문제들과 그 현황에 대해 간략하게 살핀다. 그리고 이런 상황에서 동물들에게도 도덕적 지위나 권리를 부여하고자 하는 싱어의 동물해방론과 리건의 동물권리론으로 대표되는 선구적인 동물윤리 관련 작업들을 비판적으로 검토하면서 이런 작업들이 이론적이고 실천적인 차원에서 문제점을 갖는다는 점을 밝힌다. 나는 이런 이론들이 문제가 되는 이유가 규칙중심적이면서 개체주의적인 성격을 지니기 때문이라고 지적한다. 그래서 이를 극복하기 위한 방안으로 덕 윤리적 접근방식을 응용하고 있는 허스트하우스, 제임스 그리고 오닐 등의 여러 논의들을 검토한다. 그런데 덕윤리적 접근이 규칙중심적이고 개체주의적인 윤리적 접근의 난점들을 어느 정도 해소해주기는 하나, 그렇다고 동물과 관련한 실천의 문제를 말끔하게 해결해 주는 것은 아니다. 그래서 마지막으로 그나마 소극적인 의미에서 윤리적 실천을 가능하게 하려면, 우리는 단일한 원칙이나 기준 그리고 단일한 윤리적 접근방식에 의존하려고 할 것이 아니라, 우리의 능력을 다양한 방향으로 최대로 발휘하여 최선의 행위 대안을 찾기 위한 고민을 멈추지 말아야 한다는 점을 강조한다.
Abstract
This paper examines what is the right and practicable way to treat animals by reflecting on how humans exploit and treat animals. To do this, I first briefly look at the various ethical issues that arise in relation to animals and current situations of them. And I will review the pioneering tasks that are concerned about these problems and give moral status or rights to animals. However, these animal ethics, represented by Singer and Regan's animal liberation theory and animal rights theory, have problems in theoretical and practical aspects. I point out that these theories are problematic because they have a rule-based, individualistic characteristic. To overcome these problems, I will review several discussions by Hursthouse, James and O'Neil, who are applying the virtue-ethical approach to them. However, it is pointed out that the virtue ethical approach will solve some of the difficulties of rule-centered and individualistic ethical approaches, but that the problem of practice related to animals is not fully solved. Therefore, finally I emphasize that we should not stop worrying about finding the best alternatives to act by utilizing ethical inference methods such as reflective equilibrium methods or practical wisdom, even if we can make ethical practice in a passive sense possible.
