전지구 사회에서의 생명의료윤리: 역량 접근법을 중심으로

본 논문의 목적은 최근 들어 관심이 고조되고 있는 전지구적 생명의료윤리의 특 성이 무엇인지를 검토하고, 이러한 특성을 반영하는 생명의료윤리학의 이론적 토대 로 적합한 논의가 무엇인지를 모색하는 것이다. 본 논문의 분석에 따르면, 전지구 적 생명의료윤리의 윤리적 사안들은 전지구적 관점과 생명의료윤리의 관점이 교차 하는 영역에 있으면서도, 양자의 논의에 환원될 수 없는 확장된 성격을 갖는다. 이 런 이유로 인해, 전지구적 생명의료윤리학은 학문적 독자성을 가지고 성립하여 이 러한 윤리적 문제들을 포착하고 대응할 필요가 있다. 그런데, 이러한 전지구적 생 명의료윤리학의 이론적 토대로 주목받고 있는 권리 중심적 논의는, 정당성과 실효 성에서 취약하다. 왜냐하면, 권리 논의 자체가 권리 정당화에 근본적으로 취약하며 권리들 사이의 충돌에 대해 효과적인 대응을 하기 어렵기 때문이다. 따라서 본 논 문은 권리 중심 논의가 갖는 한계를 극복할 수 있을 뿐만 아니라, 그 자체로 정당 성과 실천성을 담보하는 역량 접근법이 전지구적 생명의료윤리의 이론적 토대로 적 합하다고 주장한다. 왜냐하면, 역량 접근법의 역량 개념은 건강 또는 보건의료 개 념이 갖는 중층적 성격을 포착하기에 효과적이며, 역량 접근법은 보편성과 특수성 이 함께 요구되는 전지구적 성격을 반영할 수 있을 뿐만 아니라 권리 중심 논의가 갖는 한계를 극복하고 제도적, 비제도적, 개인적 차원의 통합적 구조를 통해 건강 또는 보건의료 역량 증진에 효과적인 실천적 논의이기 때문이다.
Abstract
The purpose of this paper is to examine the characteristics of global biomedical ethics and, on the basis of this examination, to search for a relevant theoretical foundation of global biomedical ethics, which is theoretically justifiable and effectively responds to biomedical issues in the global society. According to the analysis of this paper, the ethical issues of global biomedical ethics are in the cross section of global ethics and biomedical ethics, but they cannot be reduced to each area and should be dealt with beyond both areas. For these reasons, global biomedical ethics needs to be established with an academic independence to capture and respond to these ethical issues. However, the rights-based theory, which is considered as an established theoretical basis of global biomedical ethics, is weak in justification and effectiveness. This is because the rights-based theory itself, despite its normative and popular status, does not provide a justifiable ground and does not effectively respond to the conflict of rights. Thus, this paper argues that capability approach can be a relevant theoretical alternative of global biomedical ethics, because it not only overcomes the limitations of rights-based theory, but also can be strong in justification and effectiveness.
