이 논문은 호네트의 형식적 인륜성, 즉 개인의 좋은 삶의 영위를 위한 필수적 전제 조건으로 작용하는 상호주관적 조건들의 총체의 개념에 기초한 사회 정의론의 개요를 제시하는 것을 목표로 한다. 이를 위해 이 논문에서는 다음과 같은 작업이 수행된다. 먼저 오늘날 대안적인 정의론이 요구되는 배경으로서 기존에 주류를 이루어온 자유주의적 정의관의 한계를 롤스를 중심으로 살펴보고, 이를 극복하기 위한 두 가지 시도로 의무론의 틀 안에서 자유주의적 정의관을 보다 내용적으로 두껍게 변형하려는 시도(프레이저) 및 목적론으로 전회하여 좋은 삶의 특정한 관점을 옹호하는 방식으로 정의론을 내용적으로 풍부하게 하려는 시도(샌델)의 문제점을 각각 검토한다. 호네트의 형식적 인륜성의 개념은 목적론에 기반해 있으면서도 형식적인 성격을 갖는다는 점에서 대안적인 정의관의 기초가 될만하지만, 그의 인정이론적 정의관에서는 이 개념의 잠재력이 충분히 전개될 수 없기 때문에 본 논문에서는 이 개념을 그의 인정 이론의 맥락에서 분리하여 나름의 방식으로 정의론의 개요를 마련하는 작업을 수행한다. 형식적 인륜성이 정의론의 기초의 역할을 할 수 있으려면 이 개념에 대한 보다 구체적인 해명이 이루어져야 한다. 이를 위해 본 논문은 먼저 칸트의 의무론과의 비교 하에서 이 개념의 규범적 내용의 핵심을 일반적인 차원에서 해명하며, 계속해서 형식적 인륜성을 ‘코어’와 ‘주변부’ 의 두 가지 층위로 구분하여 각각의 내용을 개괄적으로 제시한다.
Abstract
This paper aims to present an outline of a theory of social justice focused on Honnett’s concept of formal ethical life (Sittlichkeit), i.e. totality of intersubjective conditions that serve as essential prerequisites for an individual to lead a good life. To this end, the following tasks are performed in this paper. First, it examines the limitations of the dominant liberal conception of justice, focusing on Rawls, to show the context for for the need for an alternative theory of justice today, and then examines problems of two attempts which aim to overcome those limitations: Fraser’s attempt to make liberal conception of justice more contentually thick within the framework of deontology and Sandel’s attempt to construct more comprehensive conception of justice by turning to teleological point of view and thereby supporting a particular conception of good life. While Honnett’s conept of formal ethical life deserves to be a basis of an alternative conception of justice in that it is teleological and formal, full potential of this concept cannot be fully delevoped in his theory of recognition. Second task of this paper is to pull this concept of formal ethical life from the context of Honnett’s theory of recognition and install it as a foundation stone for a new theory of justice. In order for formal ethical life to serve as a foundation for a theory of justice, a more concrete elucidation of the concept must be done. To this end, this paper articultates the core of normative content of the concept at a general level in comparison to Kant’s deontological view, and then goes on to divide formal ethical life into two layers, a ‘core’ and a ‘periphery,’ and to outline the content of each.
