초록

United Nations Convention on the Use of Electronic Communications in International Contracts(국제계약에서 전자적 의사표시의 사용에 관한 유엔 협약)의 목적은 국제 계약 상사용하는 전자적 의사표시의 법적 효과를 명확하게 하는 것에 있으며 본 조약의 내용은 여러 국가 그리고 학계의 많은 지지와 관심을 받고 있다. 본 조약의 주된 목적은 다음과 같다. 첫째, 국제거래법 상에서 전자상거래의 사용을 용이하게 하고, 둘째, UNCITRAL 전자상거래모델법과 UNCITRAL 전자서명모델법 두 모델법의 통일성을 보강하며, 셋째, 두 모델법을 보완하고 마지막으로 전자상거래법이 없거나 보완을 필요로 하는 국가에게 주된 법률을 제공하는 것이다. 최근에 온두라스와 싱가포르가 본 협약을 비준함과 동시에 호주와미국 등 본 협약의 서명국의 관심이 증가하고 비준 준비를 위한 국내적 노력 또한 향상되었다. 이러한 국제적 흐름에 맞추어 한국이 본 조약을 체결시 한국의 국제전자무역의 법적안정성을 향상하고 상당한 상업적 이득을 제공할 것이다. 또한, 한국은 본 조약을 통해 가장 현대적인 전자 상거래법안을 국내법으로 적용할 수 있을 것이다.
