연구 목적: 이 연구는 유족연금을 받고 있는 배우자의 재혼을 수급권 상실사유로 규정하고 있는 공무원연금법의 규정이 헌법상 재산권을 침해하는지 여부에 관한 연구이다. 연구 방법: 연구방법으로는 관련 선행연구와 대법원 판례, 헌법재판소 판례 등을 중심으로 문헌적･질적 연구를 수행하였다. 연구의 참신성을 높이기 위해 최신 학설과 판례를 반영하였다. 연구 내용: 연금수급권의 법적 성격을 분석하여 유족연금수급권의 재산권적 성격의 인정근거를 도출하였고, 재혼할 경우 유족연금수급권 상실규정이 재산권을 침해하는지 여부를 고찰하였다. 결론 및 제언: 공무원연금법상 유족연금수급권은 사회보장수급권적 성격과 재산권적 성격이 혼재된 권리이다. 재혼 시 유족연금수급권을 일률적으로 상실시키는 공무원법상 규정은 입법자의 입법형성의 재량권을 벗어난 것이며, 유족연금수급자의 재산권을 침해하는 것으로서 위헌이다.
Abstract
The aim of this study is on whether the property rights under the Constitution are infringed in the provisions on the loss of survivors pension rights in case of remarriage under the Public Officials Pension Act. Literature and qualitative studies were conducted focusing on previous studies and precedents. The new theories and precedents were reflected to enhance the novelty of the study. The legal nature of pension rights was analyzed to derive the basis of the property rights, and whether the regulation on loss of survivor’s pension rights on remarriage violates the property rights was examined. The survivor’s pension right combines the social security benefits and property rights. The provisions of the Act, which uniformly loses the survivor’s pension right on remarriage, are beyond the legislator’s discretion and it violates the property rights.
