Abstract
Two male persons raised the issue of the protection of gay rights recently, who had been denied marriage registration by the authorities having jurisdiction in Korea. In a related development, activists declared that they were scheduled to file a lawsuit over the rejection of the marriage registration to advance equality of sexual minorities. In the U.S., the cases demanding equal treatment for same sex couples have been brought about since the early 1970s. Although the complaints failed to achieve their objectives, states began to enact statutes restricting marriage to a set of one male and one female, trying to make clear the fact that only heterosexual couples could enjoy the fundamental right of marriage. In 1996, President Clinton signed the Defense of Marriage Act into law which provides that only the legal union of a man and a woman can constitute marriage, and that states can negate effect same sex marriage wedding held in other states, creating an exception to the Full Faith and Credit Clause. In 2013, the U. S. Supreme Court, in United States v. Windsor, struck down the federal Defense of Marriage Act. Windsor case appeared to be primarily about equal protection, however the Court's ruling was not based on equal protection jurisprudence. In fact, the Court's opinion was founded on the federalism meaning that the regulation of marriage has been deemed as being within the jurisdiction of the respective states. Therefore, it is said that American society's perspective on the issue of same sex marriage is in a unstable situation. President Obama, meanwhile, made a pronouncement that he no longer opposed same sex marriage. And besides the perspectives of majority of Americans recently have changed in the same direction. So, it is very difficult for the Court to declare a constitutional right to same sex marriage, or to wait for more conclusive evidences of a national consensus that same sex marriage should be recognized. Justice Marshall's observation that constitutional principles of equality evolve over time implies that the legislative body and the courts can play a positive role in initiating changes in the jurisprudence of same sex marriage in Korea.
