Abstract
There have been severe arguments how to define the right to marry and whether or not to legalize same-sex marriage. In June 2013, the Supreme Court of the United States stroke down the key provision of DOMA that deprived gay couples of equal protection of laws and basic human dignity without a sufficient justification. They failed, in my view, to identify the problem of constitutional principles with the judicial jurisdiction of the Court. This only menas a spark to fight gay marriage rather than solving the problem; this might lead America to political and moral turmoil. Windsor decision is contrary to American tradition of marriage, judicial jurisdiction, and the principle of separation of powers. Confronting fundamental constitutional problem, judges should take restricted role. And when people’s opinion getting divided in several ways, it’s better for judges to refrain from overconfidence that they only can solve nation-wide difficult political and moral problems. Being faced with constitutional uncertainty, it needs for them the virtue of restraint. Avoiding such a serious political difficulties by this judicial “deft blend of boldness and restraint,” the Supreme Court could elevate its authority; this is what Loewenstein says “sound restraint (weise Zurühaltung)” of judiciary.
