초고령화 사회로의 접근에 따른 노인장기요양보험법의 검토 - 우리나라와 독일법을 중심으로 -

우리나라의 인구 감소 문제는 매우 심각한 상태라고 할 수 있다. 출산율은 세계 최하위권이고, 고령화 속도는 선진국에 비하여 2 내지 3배 정도 빠르게 진행되고 있는 상태이다. 우리나라는 2026년경 초고령화 사회에 진입하고, 2030년부터는 아예 절대인구가 감소하게 될 것이라고 예상하고 있다. 이처럼 급속한 인구 고령화 현상은 노인들을 허약하게 할 뿐만 아니라 장애인이 발생할 가능성이 급격히 증가하여 독립적인 삶으로부터 타인에게 의존하여 살아갈 수밖에 없을 것으로 판단된다. 또한 노인계층의 상병구조를 보면, 전염성이나 급성질환 중심에서 비전염성 내지 만성질환 중심으로 변화되어 갈 것으로 판단되고 있다. 그런데 이러한 고령화 문제를 각 가정에서 스스로 해결하도록 한다면 국가 전체적인 생산력 저하와 사회적 비용 부담이 증가하게 될 수밖에 없을 것이다. 따라서 이를 사회 전체가 공동으로 해결함이 바람직하다고 본다. 그 방법 중 하나가 바로 노인장기요양보험법의 제정과 노인장기요양보험제도의 실시라고 할 수 있다. 하지만, 동 보험제도는 재정의 부족, 운영방법, 시설･인력측면의 인프라 구축 미비 등으로 인하여 동법의 제정 내지 동 제도의 도입 취지와 달리 아직까지 그 역할을 제대로 수행하지 못하고 있다. 그러한 예로, 보건복지부장관이 2017년 9월 18일 서울 코엑스에서 치매 국가책임제 대국민 보고대회에서 치매로부터 자유로운 치매 안심사회를 만들고자 ‘치매 국가책임제 추진계획’을 발표한 경우를 들 수 있다. 이에 본 논문은 제2장에서 우리나라의 노인장기요양보험의 제정 배경과 그 구체적인 내용을, 제3장에서는 2017년 독일이 장기요양 필요상태의 인정 등의 제도를 새로이 도입한 바, 그 전후의 장기요양보험법의 내용을 살펴보았다. 그리고 마지막 제4장에서는 우리나라와 독일의 제도를 비교하여 향후 노인장기요양보험법의 개선 방안을 제시하였다. 결론적으로 노인장기요양보험이 실질적으로 기능하기 위하여서는 제4장에서 우리나라와 독일의 제도를 비교한 내용을 토대로 우리나라의 기존 노인장기요양법을 개정할 필요가 있다고 하겠다.
Abstract
The problem of the demographic decline of our country is very serious. The birth rate is the lowest in the world, and the pace of aging is two to three times faster than in developed countries. Korea will enter the super aged society in 2026, and the absolute population will decrease from 2030. This rapid aging of the population makes the elderly weak and the incidence of persons with disabilities rapidly increases. As a result, the elderly can not but depend on the others. In addition, the disease structure of the elderly is changing from infectious or acute disease to non - infectious chronic disease. However, if these aging problems are solved by each family, the nation’s productivity will decrease and social cost will increase. Therefore, it is desirable that the society as a whole solve it jointly. One of such method is the enactment of the long-term care insurance law for the elderly and the implementation of the long-term care insurance system for the elderly. However, unlike the enactment of the Act or the introduction of the system, it still does not perform its role properly. In Chapter 2 of this article, I will examine the background and details of the establishment of long-term care insurance for the elderly in Korea. and in Chapter 3, I will study on the contents of the German long-term care insurance law that newly introduced the system such as the recognition of the condition requiring long-term care in 2017. Finally, in Chapter 4, I will compare two nation’s institutions and suggest methods to improve long - term care insurance for the elderly.
