독일 장기요양보험법상 보험사고와 법개정에 관한 소고

초록

우리나라는 사회‧경제적 발달과 함께 노인인구 또한 급격히 증가하고 있다. 2014년 현재 65세 이상의 노인 인구수는 542만 명으로 전체 인구의 11.3%를 차지하고 있는 고령화 사회(총인구 중 65세 이상의 인구가 총인구를 차지하는비율이 7% 이상인 사회)이다. 2011년 통계청 자료에 의하면, 65세 이상 노인인구비중은 꾸준히 증가하여 2017년에는 노인인구비중이 14.0%를 넘어서게 되어‘고령사회(aged society)’로 진입하게 되며, 2025년에는 노인인구 비중이 20%를넘어서게 되어 ‘초고령사회(post-aged society)’로 진입하게 될 것이라고 발표하였다. 우리나라는 앞으로의 고령화 사회에 대비하고, 노인 및 그 가족들을위한 부양부담을 완화하기 위하여 2008년 7월 노인장기요양보험제도를 도입하였다. 또한 최근 노인장기요양보험법의 개정을 통하여 장기요양 5등급체계를확립하였으며, 이를 통하여 우리나라의 노인장기요양보험제도가 신체기능을중심으로 설계되어 있던 장기요양인정체계를 인지기능평가라는 점에서 보완하였다. 이와 관련하여 독일은 사회법전(SGB) 제11편에서 장기요양필요상태의 개념및 장기요양등급의 구분에 관하여 법률로 규정하고 있다. 즉, 14조가 ‘장기요양필요상태(Pflegebedürftigkeit)’의 개념을 정의하면서 15조가 장기요양을 필요로하는 정도에 따라 3단계의 ‘장기요양등급(Pflegestufe)’을 구분하고 있다. 이에관해서는 ①장기요양필요상태를 판단함에 있어서 해당규정의 일상생활활동만이 기준이 되고 있는 점, ②장기요양필요시간으로 도움의 필요성을 산정하고있는 점이 문제로 지적되고 있으며, 이에 독일정부는 2015년 12월에 장기요양보험법을 개정하여, 새로운 장기요양필요상태의 개념정의 및 장기요양인정의방법을 규정하였다(2017년 1월 1일 시행예정). 본 논문에서는 독일의 사회법전 제11편 14조와 15조가 규정하고 있는 장기요양필요상태의 ‘판단요소(Merkmal)’에 관하여, 해당조문에 관한 구체적인 법해석을 중심으로 검토하고, 나아가 법해석에서 나타난 문제점을 근본적으로 해결하기 위하여 최근에 이루어진 법개정을 고찰함으로써, 우리나라 노인장기요양보험제도의 법학적 고찰에 있어서의 약간의 시사를 얻고자 한다.

Abstract

Alongside the rapid social and economic development, elderly population is growing rapidly in Korea. As of 2014 Korea is a aging society(more than 7% of population is 65 or older) and the number of aged people (65 or older) in total is 5.42 million, consisting 11.3% of the total population. According to the 2011 data of Statistics Korea, the country will become a aged society as the aged population of 65 or older will gradually increase and the ratio would exceed 14.0% in 2017. By 2025, the ratio will hit 20% and Korea is expected to enter the "post-aged society" group. The government introduced the act on long-term care insurance for the aged in July 2008. Also through the recent revision was established 5-rate structure, which could complement existing system designed on the basis of physical functions classification with cognitive functions evaluation. Meanwhile in Germany the Social Security Code XI the notion of state in need of long-term care and the categories of level is regulated. article 14 defines the notion of state in need of long-term care and the following article 15 indicate three categories based on the level of need. Regarding this, several criticisms are raised as the article ① makes long-term care decision only based on everyday activities ② put the need of assistance included in the mandatory time of long-term care. To solve this problem, the German government revised the Act on Long-Term Care in December 2015 and newly defined the notion of state in need of long-term care and recognition method(enforcement planned on January 1st, 2017). This thesis first examine the Social Security Code XI article 14 and article 15. Regarding the ‘Merkmal’ regulation for the state in need, this thesis will look through specific legal interpretation, and with the problems found, examine the implications of recent revisions conducted to address the issues. Finally in the end will aim to get implications for Korean Act on Long-Term Care for the Aged in terms of legal consideration.
