‘때린 거 미안해’와 ‘때린 건 미안한일이야’ -갈등해결을 위한 수사학(Rhetoric)과 회복적 사법의 융합-

초록

갈등의 원인은 다양하지만, 갈등의 최하부 기저에는 인간의 욕망이 자리 잡고 있다. 개인, 조직, 기관, 지역, 그룹 등의 모든 갈등의 출발은 욕망이며, 다만 그것이 개인의 것이냐 혹은 집단의 것이냐의 차이 뿐이다. 그렇다면, 갈등해결의 출발점은 결국 개인이 되어야 하며 집단의 단위까지 확대되어야만 하는 것이다. 범죄학과 형사사법학에서는 근래 회복적 사법이 도입되어 운용 중에 있다. 피해를 회복하고 가해자와 피해자의 관계를 회복하고, 사회가 가해자를 다시 받아들이게 한다는 점에서 회복적 사법은 결국 갈등해결의 한 방법인 것이다. 많은 연구에서 회복적 사법의 내용, 형식, 방법 등이 연구되었으나, 갈등의 출발점인 가해자와 피해자의 접점, 즉 대화의 기법과 방법에 대한 연구는 진행된 바 없다. 본 연구는 당자간의 효과적인 대화를 회복(즉, 갈등해결)의 출발점으로 인식하고, 갈등해결을 위해 수사학(rhetoric)의 설득(persuasion) 이론들을 활용하여 효과적인 가해자-피해자 대화 방법의 틀을 제시하고자 하였다.

Abstract

There may many different reasons for conflicts, but the fundamental cause of conflicts would be human desire. The core of conflicts among individuals, organizations, institutions, regions, and groups would be human desire, and only difference would be the levels of unit under study. So, any conflict resolution may address individual’s desire and it should be expended to organizational and group levels. In the field of criminology and criminal justice sciences, restorative justice has received significant amount of academic and practical attention. In the sense that restorative justice brings offenders and victims into the discussion table, where offenders publicly accept damages they implied and apologizes for their offenses and victims emotionally accept the apology, it is a form of conflict resolution strategies. Many studies have focused on methods, types, and structures for restorative justice practices, but no study has been carried out to find effective dialog between offenders and victims. This study was purported to investigate what would be effective and restorative dialog using rhetoric and persuasion theories based on symbolic interactionism and information processing theory as a theoretical framework. Based on the findings, this study provides several practical policy implications to improve restorative justice practice.
