본 연구에서는 교정학이 교정행정의 기술적인 문제를 해결하는 역할에서 사회갈등과 범죄를 막고 해결하여 사회복지와 행복 달성의 역할까지 맡아야 하며, 이를 위해 인문학, 특히 철학과 교정학의 만남을 통한 새로운 교정담론 창출이 필요하다는 점을 논의하고, 새로운 교정담론의 내용과 실천방법을 제시하고자 한다. II장 “철학과 교정학의 만남”에서는 사회갈등과 범죄 문제를 해결하는데 교정의 역할이 크며 이를 위해서는 교정학에 철학이 접목될 필요성이 있음을 논증하고 철학적 사유의 특징으로 비판적 사고, 변증법적 사고, 진선미성의 종합적 사고 등을 제시한다. III장 “형사사법의 대안적 담론”에서는 고전적 형사사법의 대안적 담론 중 회복적 사법을 중심으로 그 의의와 한계를 검토하고 바람직한 대안적 담론의 방향을 제시한다. IV장 “인문교정담론과 교정의 역할”에서는 철학과 교정의 만남의 구체적인 영역으로 철학적 교정학, 생명평화공동체, 언어의 미학적 사용을 제시함으로써 새로운 환경에 맞는 대안적 교정모델을 생각해본다.
Abstract
In this paper I wanted to suggest a correctional paradigm for solving the social conflicts and crimes in modern society through the consilience between philosophy and corrections. I have been used to think that criminology and corrections in sociological methods would be need to meet by philosophy in humanities. Because I think that interdisciplinary study could make possible the new discourses of relevant study in corrections. In this aspects new correctional paradigm, i.e. restorative justice could be created. In chapter II, I treated that it need to combine philosophy with corrections for solving the social conflicts and crimes, and suggested that the characteristic philosophical thinking is critical thinking, dialectical thinking and synthetic thinking of truth, good, beauty and holy. In chapter III, I discussed critically the meaning of restorative justice paradigm in alternative criminal justice paradigms. In chapter IV, I proposed philosophical corrections, Life Peace Community and aesthetics of language as the new paradigms of solving the social conflicts and crimes through the consilience between philosophy and corrections.
