총 설: 숨김정보검사 기법 중심의 심리생리검사 증거능력 부여에 관한 고찰

초록

그간 심리생리검사 (PDD) 에 대한 여러 연구와 논의는 심리생리검사 기법 중 비교질문검사 (comparison question test; CQT) 기법에 대해서만 한정되어 있을 뿐 비교질문검사 기법과 검사 방법 및 심리적 기제가 서로 다르다고 알려진 숨김정보검사 (concealed information test; CIT) 기법에 대해서는 거의 다루지는 않았 다 . 본 연구는 국내에서는 처음으로 숨김정보검사 기법의 증거능력 부여 여부에 대하여 탐색해보았다 . 이 를 위해 먼저 , 비교질문검사와 숨김정보검사 기법의 차이에 대해서 알아보았고 , 국내법과 관련하여 숨김정 보검사 결과의 전문법칙 및 자백배재법칙 적용 여부를 고찰하였다 . 또한 , 관련 학계에서 활발하게 이루어 지고 있는 연구 결과를 토대로 , 숨김정보검사가 국내 판례에 제시된 형사소송법 상 증거능력 부여 요건을 충족시킬 수 있는지에 대해 검토해 보았다 . 아울러 숨김정보검사의 활용성 및 증거능력 부여 가능성을 높 이기 위하여 숨김정보 선별검사 도입을 제안하였다 . 본 연구가 심리생리검사 증거능력 부여 여부에 대한 논의의 시발점이 되기를 기대한다 .

Abstract

There have been several rounds of discussions regarding the admissibility of evidence of PDD. However, the discussions were limited to CQT among the PDD techniques. Thus, they were not discussed in regards to the CIT, which is known to be different in the method of examination and psychological mechanism from CQT. Therefore, we explored admissibility of evidence of CIT for the first time in South Korea through this research. First, we looked into the differences between CQT and CIT, and considered whether the exclusive rule of hearsay and confession rule applies in relation to the domestic law or not. We further reviewed whether the condition of admissibility of evidence meets under the Criminal Procedure Law presented in domestic precedents or not based on researched results in related to academia. In addition, we proposed screening CIT to increase usability and applicability of evidence of CIT. We expect this study will provide a chance to reevaluate CIT’s value as a legal evidence. CIT will then be used as an active method to eradicate the modern crime challenge in the near future.
