Abstract
This study attempted to specifically explore the factors affecting sentencing judgment in spouse murder cases. As a result of analyzing 81 cases of spouse murder from 2014 to 2019, the Defendant group who were the victims of domestic violence were shorter than the Defendant group who did not have domestic violence and was the perpetrator domestic violence in terms of prison sentence. In addition, as a result of examining the sentencing factors that directly affect the sentencing, when premeditated crime, abusing corpse, a lack of reflection, cruel methods of committing and the abandonment of a corpse were mentioned in the sentencing, the sentence was significantly longer than when it was not. And In cases where surrender and no-punishment were mentioned, significantly shorter sentences were reported than cases where surrender and no-punishment were not mentioned. Unlike previous studies, women were shorter than men in terms of prison sentence. In fact, because many female accused were the victims of domestic violence before they murdered their husband, they resulted in a relatively short prison term according to sentencing criteria. This study is meaningful in discovering the factors affecting sentencing by analyzing the murder judgment in spouse murder cases, which are currently a social issue, especially domestic violence. In addition, despite the public's high interest in the judgment of murder due to domestic violence, it is significant in that few studies have been conducted on the judgment of spouse murder, especially the husband murder of Battered Wives, since 2007.
