본 연구에서는 친밀한 파트너 살인에서 스토킹 행위 유무에 따른 범죄행동특성에 대해 검토하였다. 이를 위해 2019년부터 2022년 사이에 친밀한 파트너 살인사건 1심 판결문 67건에 대해 스토킹이 존재하는 살인 집단과 그렇지 않은 집단을 분류하여 두 집단 간 범죄 특성을 분석하였다. 분석 결과, 친밀한 파트너 살인에서 스토킹이 존재하는 집단의 경우 가해자가 전과기록이 있는 경우가 높았으며, 범행도구를 사전에 준비하고 사건 발생 당시 피해자와 동거하지 않는 경우가 높게 나타났다. 또한 살인사건이 발생하기 전 피해자가 가해자의 폭행 등 일련의 행위로 인해 경찰에 신고한 경우가 높은 것으로 확인되었다. 더불어 스토킹이 존재하는 살인사건을 예측할 수 있는 범죄행동특성 요인을 검토하기 위해 로지스틱 분석을 실시한 결과 스토킹이 존재하는 살인사건의 경우 스토킹이 존재하지 않는 살인사건에 비해 가해자가 전과기록이 있는 경우가 약 7배가량 높았으며, 범행도구를 준비하는 경우가 약 9배가량 높은 것으로 확인되었다. 또한 살인사건 발생전 피해자가 경찰에 신고하는 경우가 약 4배가량 높은 것으로 나타났다. 이러한 결과는 친밀한 파트너 살인사건에서 스토킹 범죄에 대한 이해를 높이는 것은 물론 피해자의 실질적인 보호를 위한 정책 마련에도 유용하게 활용될 것으로 판단된다.
Abstract
We compared crime scene factors of homicide precipitated by intimate partner stalking (IPS) and not precipitated by intimate partner stalking (non-IPS). Data were analyzed from 67 first-trial rulings for criminal cases that involved such murders between 2019 and 2022. Subsequently, we divided the cases into two groups: the homicide precipitated by intimate partner stalking and not precipitated by intimate partner stalking groups. The results indicated that in IPS the perpetrator often had a criminal record and did not live with the victim at the time of the crime. Furthermore, weapons were often prepared in advance and the victim had previously reported the perpetrator’s assault to the police. We also explored the crime scene factors that could predict homicide precipitated by intimate partner stalking via a binary logistic regression analysis. The results indicated that criminal records and preparing weapons were approximately seven and nine times more likely to be associated with IPS, respectively. Moreover, homicide case in which the victim previously reported the perpetrator to the police before the murder was approximately four times more likely to be associated with IPS. These results can be useful in enhancing understanding of stalking crimes in intimate partner homicides and preparing policies for the practical protection of victims.
