Abstract

This Study aims to grope for the role of police to settle the sound culture of assembly and demonstration. The first section of korean Constitution Article 21 regulates freedom of assembly to all people in our country. Therefore, the right of Assembly and demonstration is basic right on the constitution, and its freedom must be guard to the maximum. Although the freedom of assembly and demonstration is one of the most important basic right which contributes to the development of democratic politics by pursuing the common interests through expression of collective assertions, the recent aspect of assembly and demonstration show up severe violence. Starting from such recognition, this study finds several problems regarding assembly and demonstration such as people's recognition, the way demonstrators express their opinion, and the way police deals with them. Moreover, this study focuses the candlelight demonstration on the beef imported from America. In order to solve these problems and to establish the culture of sound assembly and demonstration this study suggested the following effective plans about assembly and demonstration of police. First, It must be provided manuel to maintain the consistency of the law enforcement and the method of control. Second, It must be needed to train expert controlling the unlawful and violent assembly and demonstration. Third, It must be provided suppression equipment and various control system to release the conflict among people. Fourth, It must be introduced to the equipment for arresting the users of force and providing scientific evidence collection equipment. Last, It must be needed the reporting expert and the strengthening personality education for policeman suppressing violent demonstration.
