경찰조직의 인권보호 노력도와 치안성과 간의 상관관계에 대한 연구

초록

경찰은 경찰관들의 법적 소양 및 인권 의식이 과거에 비해 크게 향상됐을 뿐만 아니라 인권침해 방지 대책 등을 마련해 왔다고 주장해 왔으나 여전히 경찰 활동의 인권침해에 대한 문제가 지속적으로 제기되고 있다. 그 원인을 두고 성과 우선주의적 조직문화를 지적하는 견해가 있으며, 국가인권위원회 역시 수사 과정에서의 인권침해 요인으로 경찰관들의 과도한 의욕을 지적한 바 있다. 본 연구는 경찰조직의 ‘인권 수준’과 ‘치안 성과’라는 두 가치가 과연 상호 배치되는 것인지 그 관계를 밝히고 인권 수준이 치안 성과에 어떤 영향을 미치는지에 대해 실증적으로 검증하고자 한다. 이를 위해 서울 소재 31개 경찰서를 분석 대상으로 하여 독립변수로는 ‘경찰서별 인권 수준’을, 종속변수로는 ‘범죄검거율’과 ‘치안만족도’를, 통제변수로는 ‘범죄 발생률’과 ‘경찰관 1인당 담당인구’, ‘경찰관의 직무만족도’를 삼아 각 변수 간 상관관계 분석과 회귀분석을 실시하였다. 그 결과 실제 범죄검거율이 높아지면 경찰 인권 수준이 낮아지는 것으로 나타났다. 그러나 인권 수준이 고객만족도를 하락시키고 있지는 않은 것으로 나타났다. 향후 경찰서별 환경적 변인, 경찰서장의 공공관리 기법으로서의 다양한 변인들을 포함된 연구가 필요할 것으로 보인다.

Abstract

The low level of human rights consciousness of the police organization and its point of view on violation of human rights during criminal investigations have been continuously raised among people. In response, the police have insisted that the police officers' legal literacy and human rights awareness have improved greatly, and that measures have been taken to prevent violations of human rights. However, it is true that the issue of human rights violations of police activities is still being raised. If so, is the relationship is trade-off between police performance and human rights? The purpose of this study is to verify empirically how the level of human rights affects police performance. For this purpose, 31 police stations in Seoul area were analyzed. For this analysis, I set variables as follows: “Human rights level by police station” as independent variables; “Crime arrest rate” and “Police satisfaction” as dependent variables; “Crime incidence” and “Police Officer' s Job Satisfaction” as controlled variables. With these variables the correlation analysis and regression analysis were performed. As a result, when the actual arrest rate of crime increased, the level of police human rights level decreased, while the level of human rights did not seem to decrease the level of customer satisfaction.
