경찰 인권침해의 실태분석 및 개선방안에 관한 연구

경찰이 시민의 인권보호를 위해 앞장 서야 하는 이유는 인권보호가 경찰임무의 본질이며, 시민의 신뢰를 확보하기 위해서 필수적이며, 유엔 가입국으로서의 정치적ㆍ도덕적ㆍ법적 의무이고, 인권보호 의식이 사회 전반에 걸쳐 확산되고 있기 때문이다. 그러나, 여전히 연간 1,000여건 이상의 경찰활동 관련 진정이 국가인권위원회에 제기되어, 시민의 입장에서는 경찰의 인권보호가 미흡한 것으로 여겨질 수 있다. 또한, 제기된 진정사건들 대부분이 경찰관이 관련 법률들을 철저하게 파악하고 높은 인권의식을 지니고 있었다면, 사전에 예방할 수 있는 것들이어서 많은 아쉬움을 남기고 있다. 경찰에 의한 인권침해 상황을 개선하기 위해서 첫째, 인권경찰로서의 정체성을 확립하고, 둘째, 경찰관의 직무수행능력을 향상시키고, 셋째, 인권 존중적인 업무수행를 행하고, 넷째, 인권 친화적 근무환경을 조성할 필요가 있다.
Abstract
The reasons why the police must protect human rights are the following. To protect human rights is the basic mission of police, and human rights protection is essential to citizen's trust, and the awareness to human rights protection is pervasive over the society, and human rights protection is compulsory from a political, ethical, legal point of view as an UN member. To improve human rights violation by the police, the police must perform the followings. First, to establish the identity and value as the police to protect human rights, the police must realize the police role and mission, send the planning paper for human rights protection, and appraise the human rights cognition level at the time of hiring new policemen. Second, to improve the human rights cognition and performance ability, the police must practice the human rights training effectively, strengthen the training of policemen who have violated human rights, activate the field study meeting in each police department, increase the proportion of human rights protection division in promotion test. Third, to conduct the police work which respects human rights, the police must reinforce the management and supervision of the police work, publish the human rights manual, enact the prize for human rights protection. Forth, to build up the environment friendly to human rights, the police must survey the reality of human rights violation periodically, promote the atmosphere for human rights protection, publicize the cases that have protected human rights, and protect the social weak more positively.
