국가인권위원회 결정례에 나타난 경찰 인권침해의 특성

이 연구는 국가인권위원회 주요 결정례를 대상으로 경찰 인권침해 사건의 특성을 경찰-시민(진정인)의 개인적 요인, 경찰활동 유형, 진정인의 행위, 상황적 요소들을 고려하여 종합적으로 분석하고자 하였다. 내용분석은 2002년부터 2021년간의 기간 동안 「국가인권위원회 결정례집」에 게재된 경찰의 인권침해 진정 사건을 대상으로 하였으며 최종적으로 247건의 사건이 분석대상으로 수집되었다. 주요 분석 내용은 다음과 같다. 경찰 인권침해 사건은 수사절차 위반 및 경찰력 과잉에 의한 침해가 다수를 차지하며 수사 및 형사, 생활안전 부서에서의 발생이 높은 것으로 나타났다. 이와 같은 부서에서 체포, 구속, 피의자 조사 등 수사 관련 활동과 사건 현장출동 및 초동 조치를 행하면서 시민과의 직접적인 접촉 시에 인권침해의 가능성이 커지게 되는 것이다. 또한, 경찰의 적극적인 침해행위가 아닌 피해자 보호 및 피의자 의료 및 건강권 침해, 경찰 시설 및 환경적 조치의 미흡 등 경찰의 소극적 대응으로 인권침해가 발생하는 경우와 장애인, 미성년, 외국인 등의 사회적 약자에 대한 인권침해에 주목하고 이에 대응해 나갈 필요가 있다. 일부 사건에서는 경찰의 인권침해 행위가 일방적으로 이루어지는 것이 아닌 진정인의 폭력 등의 행위와 동시에 또는 순차적으로 일어나는 상호작용 상황에서 발생함을 유추해 볼 수 있었다. 인권침해 사건은 경찰서, 지구대와 같은 경찰관서에서 발생한 비율이 상대적으로 높은 비율을 차지하였다. 마지막으로 인권위원회의 결정 내용은 경고 및 주의 조치의 권고가 가장 많은 것으로 나타났다.
Abstract
This study analyzed the characteristics of human rights violations by the police targeting the petition case of the National Human Rights Commission of Korea. The characteristics of the case were comprehensively analyzed considering the individual factors of the police and citizens, the type of police activity, the actions of petitioners, and situational factors. The content analysis was conducted on petition cases during the period from 2002 to 2021, and 247 cases were finally collected. The main analysis results are as follows. As a result of the analysis, it was found that there were many cases of human rights violations related to investigation procedures and the use of police force. In addition, it was found that human rights violations occurred frequently in the investigation, criminal, and life safety departments. Because these departments have direct contact with citizens, the possibility of human rights violations increases. It is necessary to pay attention to cases where human rights violations occur due to the passive response of the police, such as victim protection, the suspect's medical and health rights, facilities and environmental measures. Likewise, the police should be prepared for the protection of human rights against the socially disadvantaged. In some cases, human rights violations by the police occurred in interactive situations such as violence and escape of citizens. It was also found that many cases occurred at police stations. Finally, the decision of the Human Rights Commission of Korea was found to have the most recommendations for warning and cautionary measures.
