영국 해상적하보험에 있어서 담보위험의 확장에 관한 연구

Abstract

The Insurance Condition(insurable interest, perils covered, insurance period, insurable loss) in English Cargo Insurance has been changing through the amendment of Insurance Polish and Insurance Clauses continuously. In this paper, alteration of Perils insured in English Marine Cargo Insurance had been studied taking a focus in expansion side. The results obtained through this research is as follows. First, when Perils Clause had appeared initially in England was in 1563 that James Ypswyche Policy has been established and with the beginning from this time, Perils insured has been enumerated. Second, Perils insured enumerated on Lloyd's S.G Policy in 1779 was insured all. Third, in Old Institute Cargo Clause, Perils insured had been added Total Loss in loading, transshipment, discharge, explosion, discharge of cargo at a port of distress and War Risk, Strike Risk as form of special stipulation each other. Fourth, in New Institute Cargo Clause, with advancement of Inland Transportation System, risks such as overturning or derailment of land conveyance, earthquake, volcanic eruption has been added.
