이 글은 노인의 근로권에 관한 법적 고찰이다. 고령화는 전지구적인 현상으로 노인의 패러다임을 성공적 노화로 변화시켜 노인의 근로권을 강화시키고 있다. 경제적 측면에서 노인의 근로권은 적극적 삶의 참여의 한 부분이자 독립적 이미지를 구성해주는 핵심 요소가 되고 있다. 즉 기존의 수동적이고 상실, 쇠퇴, 분리라는 이미지를 극복하고 ‘근로’라는 적극적이고 생산적이면서도 사회참여를 통해 자아실현을 해줄 수 있는 권리로서 자리 잡고 있다. 국제적으로도 노인 인권과 관련된 국제조약이나 기구에서는 노인의 권리 중 하나로 고용과 노동을 제시하고 있으며, 시대적 추세에 부합하여 점점 더 중요한 권리로 자리매김하고 있다. 한국의 경우 높은 노인취업율에도 불구하고 심각한 빈곤과 높은 자살율은 이들의 근로권에 법적제도적 검토가 요구되는 상황이다. 우리나라의 노인의 법적 지위를 규정하고 있는 『헌법』, 『노인복지법』, 『사회보장 기본법』, 『노인장기요양보험법』 등 관련 법령에서는 아직도 노인을 취약계층으로서 보호받을 존재로 간주하고 있다. 이런 시각은 정책, 프로그램으로 구현되어 노인의 사회 문화적 이미지, 나아가 사회 속에 개인의 정체성을 구성하는데 부정적인 영향을 주고 있다. 스웨덴과 비교해볼 때 한국은 우선적으로 노인정책에 대한 패러다임을 구축해야 한다. 그리고 노인의 근로권과 사회보장권을 동시에 보장함으로써 이들의 생존권을 포함하여 사회권을 향유할 수 있도록 해야 한다.
Abstract
This article is a legal review of the right to work of the elderly. The phenomenon of aging in Korea calls for a paradigm change of senior citizens to successful aging as an active and energetic entity focusing on employment and labor of the elderly. Various international laws are increasingly strengthening the guarantee of working rights combined with the social right like pension for senior citizens. In Korea, although it compose of social discourse for active aging, but it is still premature by the Constitution, the Welfare of the Elderly Act, and the Employment Promotion for the Aged Act. They regard the elderly as being passive and special targets to be protected. This view is embodied social policy and social welfare program. It fails to properly present the active concept of employment or working rights of senior citizens based on social benefits. The government's project to find jobs for senior citizens does not cover the general elderly, mainly the vulnerable. In addition, the purpose of the plan is not to guarantee labor rights, but to the nature of social participation rather than to guarantee the right to work, which is formally guaranteed the right to work but is not being done properly in practical terms. It also showed that senior citizens in general employment are facing low wages, poor jobs, poor job security and severely human rights violations. Therefore, it is necessary to re-concept the legal status of the elderly with a more active concept. Compared with Sweden, South Korea should first establish a paradigm for senior citizens' policies. And by guaranteeing the working rights and social security rights of the elderly at the same time, they should be allowed to enjoy social rights, including their right to live.
