노인일자리사업의 입법론적 검토

Abstract

Senior employment program has pushed ahead based on the Senior Welfare Act, support for social participation of elderly people (Article 23), Establishment and operation of exclusive institution for the aged employment(Article 23, paragraph 2), security and income guarantees (paragraph 11), and encouragement of leisure, cultural and social activities (paragraph 14). However, it usually has pushed ahead based on the guidelines on operation of business due to the insufficiency on legal basis. There is a lot of confusion in the business project process. Types and categories are changed each year without a stable, systematic business operation, due to the limitations of the act itself. It finally fails to achieve the legislative purpose and has been failed repeatedly. As the average life increases, the elderly population increases sharply. However, many seniors have no income, and the senior poverty rate is high therefore older people who hope to gain jobs for income are expected to increase continuously. But a private support method on the elderly employment is minimal among all business types, and depending too much on financial support from the nation and local government can not satisfy the rising elderly population and their needs. In a situation of increasing the national budget and the number of participations on senior employment, it is unfit in continuity and stability aspects for managing the senior employment program by program guidance and regulation of the senior welfare act. Senior employment program is a legal system as an active elderly employment and the income security for elderly, review is requested. To do so, there is a limit to implement through current renew elderly welfare policy. Establishing individual law in connection with senior employment program should be reviewed with various regulations that can improve possibility of success for continuity and stability on business operation system besides manpower and budget. This paper analyzed the problem and limits of senior employment program and suggested specific establishment of the individual law for solving the problem. It also propose the basic direction, the main issue, and the contents to be included in a key regulation.
