자영업자의 사회보험 수급권에 관한 연구-스웨덴 사례를 중심으로-

우리나라는 국제적으로 비교했을 때 자영업자의 수가 많은 편이다. 그리고 이들 중 상당수가 프리카레아트(precariat)로 전락할 위험에 처해있다. 대한민국 「헌법」 제 34조 ‘행복 추구권’과 「사회보장기본법」 9조 ‘사회보장을 받을 권리’는 법적으로 자영업자에게 사회보장 수급권자임을 선언하고 있다. 그러나 실질적으로 자영업자는 사회보장권리 중 사회보험 수급권에 취약한 존재이다. 「고용산재보험료징수법」을 포함한 사회보험법은 자영업자를 사회보험에 포함하고 있지만 의무조항이 아닌 경우가 커 실질적인 법적 효력은 크지 않다. 따라서 이들은 일반 국민들과 비교해서 사회보험료가 체납된 비중이 높고 특히 실업보험과 산재보험에서 배제되어 있다. 반면 스웨덴의 경우 상대적으로 자영업자의 비중이 낮은 편이다. 그 이유는 바로 고용정책과 사회보장제도가 탄탄하기 때문이다. 사회보험체계는 근로자와 거의 별 차이가 없다. 법적으로도 세법을 제외하고 민법이나 사회법에서 근로자와 유사하게 정의내리고 있다. 더욱이 법정 사회보험은 모든 국민들을 대상으로 하는 강제성을 가지고 있기 때문에 자영업자의 사회적 위험에 적극적인 대처가 가능하다. 특히 실업보험과 산재보험 체계는 한국과 비교해볼 때 자영업자 보호에 있어서 월등히 우수하다고 볼 수 있다. 자영업은 미래의 일자리로서 많은 국가에서 창업(start-up)이라는 이름으로 장려하고 있다. 이는 사회보험 패러다임의 전환을 요구하고 있다. 한국도 4차 산업을 준비하는 가운데 자영업자들의 활성화를 위해 사회보험체계의 재정립이 요구된다.
Abstract
Article 34 of the Constitution of the Republic of Korea, the right to seek happiness and social security under Article 9 of the Basic Social Security Act, declare that all citizens have the right to receive social security. However, the self-employed are virtually vulnerable to the right for social insurance entitlement among social security rights. Compared to the ordinary Worker, they are heavily in arrears with private insurance premiums and, moreover, excluded from unemployment and industrial insurance. This suggests that it is bound to become more vulnerable to the dangers of capitalist society: old age, disease, industrial accidents and unemployment. Internationally, the number of self-employed people is on the rise, and they are degenerating into precariats. Korea is no exception. On the other hand, the proportion of self-employed people in Sweden is relatively low. That's because employment policies and social security systems are solid. The social insurance system is little different from Sweden's subordinate workers. By law, the definition is similar to that of workers in civil and social laws, except for tax laws. Furthermore, since legal social insurance has a mandate for all citizens, it is possible to actively cope with the social risks of self-employed people. In particular, the unemployment and industrial insurance systems are far superior compared to Korea. Self-employment is a future job and is encouraged in many countries under the name of start-up. This calls for a shift in the social insurance paradigm. South Korea is also required to redefine its social insurance system to revitalize the self-employed while preparing for the fourth industry.
