영국 고용보험법의 자영업자 적용 현황과 시사점

한국의 고용보험법은 근로기준법 상 근로자를 원칙적 적용 대상으로 보고 예외적 적용으로서 보험료징수법에 따라 고용보험에 가입하거나 가입된 것으로 보는 자영업자를 상정하고 있다. 비전형, 불안정 고용형태의 일하는 사람이 증가하고 자영업자 비율이 대단히 높은 한국적 상황을 고려했을 때 고용보험으로부터 보호받는 집단의 규모가 작을 수밖에 없고 실업, 직업능력개발 기회의 부재라는 위험으로부터 보호받지 못하는 상황에 처해 있는 것이다. 특히 특수고용직, 플랫폼 노동의 보호 필요성에 대한 사회적 논의가 진행되면서 고용보험이 근로기준법 상 근로자와 자영업자의 일부만을 보호하는 문제점이 더욱 분명히 드러나고 있다. 이러한 문제의식에서 전국민고용보험제도 등 자영업자에 대한 고용보험 적용 논의와 정책이 시행 중인데, 자영업자는 일하는 방식과 경영상 결정 권한 여부, 노동시간, 소득의 수준과 양상 및 정산 방식 등에 있어 근로자와 다른 모습을 보인다. 이러한 차이는 고용보험의 가입자격, 수급자격 등의 판단 기준을 설정하고 자영업자 고용보험 적용제도를 설계함에 있어 중요하게 고려되어야 할 지점이다. 이 연구에서는 자영업자에 대한 고용보험 적용의 역사가 오래된 영국의 사례를 검토함으로써 한국의 고용보험법 관련 주는 시사점을 확인하고 개선방향을 제안하고자 한다.
Abstract
Korea's Employment Insurance Act considers workers as the subject of application in principle under the Labor Standards Act, and as an exception, assumes self-employed persons who have or are deemed to have been enrolled in employment insurance according to the Insurance Premium Collection Act. Considering the situation in Korea where the number of workers with atypical and precarious employment types is increasing and the rate of self-employed people is very high, the size of the group protected by employment insurance is inevitably small, and it is difficult to protect against the risks of unemployment and lack of vocational skills development opportunities. In particular, as social discussions on the need for protection of specially employed workers and platform labor progress, the problem that employment insurance only protects part of the workers and the self-employed under the Labor Standards Act is becoming clearer. In these context, such as the National Employment Insurance System, are being implemented. It is important to consider the difference between employee and self-employed in terms of way of working, working hours, income situation when setting the criteria for determining eligibility for employment insurance, such as eligibility for employment insurance, and designing the employment insurance application system for the self-employed. In this study, by examining the case of the UK, which has a long history of applying employment insurance to the self-employed, it is intended to confirm the implications of Korea's employment insurance law and suggest directions for improvement.
