한국의 경제발전과 산업구조 법제의 분석과 전망

역대 정부들은 경제발전을 위해서 인위적인 시장개입에 의한 산업구조조정을 고려하였다. 경제발전에는 산업 클러스터의 안정성과 경쟁력이 중요하기 때문에 산업구조가 낮은 단계에서 높은 단계로 발전하고자 집중적이고 선별적 산업구조정책이 채택되었다. 지난 60년 이상 산업구조조정법제의 시행과 관련된 법원의 재판을 찾아볼 수 없다. 이는 권위적인 정치체제 하에서 경제정책은 일관되게 정치권력에 예속되어 있다는 사실을 반증하고 있다. 정치가 법과 경제보다 우월하다는 인식은 정경유착에 대한 법적 책임이 미약하다는 특성을 시사한다. 지난 60년 간 한국의 경제발전을 달성하는데 산업구조법제가 아래의 세 시기로 구분된다. 제 1기(1961년～1985년)의 초기에는 풍부한 저임의 노동력에 기초한 경공업 위주의 수출정책에 입각하고, 나아가 집중적인 자원투입의 ‘중화학공업육성정책’에 기초한 장기의 계획적인 산업구조정책을 중시하였다. 세계경제의 변동성과 수출지향의 경제정책이 경제발전의 원동력이 되었다. 제 2기(1986년～1998년)는 ‘공업발전법’을 기초로 수동적인 산업구조조정을 통해서 정경유착과 시장실패의 폐해를 낳았다. 때문에 시장의 공정경쟁의 중요성이 강조되었다. 제 3기(1999년～2016년)는 외환위기 극복과 산업고도화를 위하여 ‘산업발전법’에 기초한 복합적 산업구조조정과 부실기업정리를 촉진하고자 기업구조조정촉진법이 시행되었다. 사실, 우리의 경제운용은 ‘정치-관료-대기업’의 민관협력 체제를 구축하여 ‘상품․노동․금융’ 시장에 대한 선별적인 시장개입의 규모와 수준이 점차 축소되었다. 특히, 자본시장에 대한 낮은 수준의 시장개입을 통하여 지속적인 기업구조조정의 어려움에 처하고 있다. 왜냐하면 외국투자자본이 자본시장에서 점하는 비중이 매우 높아진 상태에서 재벌기업의 경영권 방어도 불안한 상태에 놓여있기 때문이다. 요컨대, 산업구조조정은 부실기업의 구조조정을 대비하는 것과 기업의 경쟁력을 강화시키는 두 가지 법제도가 필요하다. 산업경쟁력의 강화는 ‘과잉규제’, ‘과소투자’, ‘과소경쟁’의 취약성을 극복하려면 ‘창업-성숙-정체’라는 사업의 라이프 사이클(life-cycle)에 맞춰서 단계별로 지원방안이 마련되어야 한다. 특히, 경제정책의 수평적 및 수직적 의사결정, 지역과 수도권의 경제공간의 효율성 제고를 위한 산업고도화가 요구된다.
Abstract
The state considers industrial restructuring by artificial market intervention for economic development. Because the industrial structure is important for the stability and competitiveness of the cluster, the selective industrial structure policy is adopted to develop the industrial structure from the low stage to the high stage. In the course of enactment of Industrial upgrading legislation, there has been found no litigation in courts over past 60 years. This shows the special fact that the economic realm is consistently subordinated to politics in Korea. Over the past 60 years, Korea's industrial structure policy has been divided into three periods based on goals and legal system. In the first period (1961~1985), the long - term and planned industrial structure policy was implemented based on the 'Heavy Chemical Industry Promotion Act'. In the second period (1986~1998), the passive restructuring in the industry based on the Industrial Development Law resulted in the deterioration of canonical cohesion. In the third period (1999~ 2016), the corporate restructuring promotion law was enacted in order to solve the foreign exchange crisis and to promote industrial restructuring and liquidation of insolvent companies based on the Industrial Development Act. The government 's economic management has gradually reduced the size and level of market intervention in order to control the planned industrial structure for the' commodity, labor, and financial' market by establishing a public - private cooperation system of' political - bureaucratic - large corporations'. In short, Industrial restructuring policy requires two legal systems to prepare for restructuring of insolvent companies and to strengthen the competitiveness of enterprises. In particular, in order to overcome the weakness of 'over-regulation', 'under-investment' and 'under-competition', strengthening industrial competitiveness will be supported gradually in according to the life-cycle of the business starting -mature-recession.
